(516) and if more Money shall arise and Come to the Hands of the said Thomas Rutland including the said Sum of Eleven hundred and Eighty three Pounds Nineteen Shillings and three Pence Maryland Currency the amount of the said Inventory Exhibited as aforesaid and the other Personal Estate that hath or may come to the Hands of the said Thomas Rutland and by the Sales of the said remaining two third Parts of the Lands afs.d than shall be Sufficient to Pay off and discharge the said Mortgage and all Other Debts which the said Benjamin Welsh did once at the time of his death that then he the said Thomas Rutland shall and will Pay such Overplus to him the said John Welsh his Executors Administrators or Assigns And the said Thomas Rutland for himself his Heirs Executors and Adm.rs doth Covenant and grant to and with the said John Welsh that he the said Thomas Rutland will well and truly Assign the Dower of the said Ann as aforesaid and the said Part of the af.d Tract of Land called the Resurvey on Ridgways Farm on such Payment is af.d being made by the Purchaser or Purchasers thereof as af.d will Convey in the Manner herein before Mentioned and the remaining two third Parts of the said Premises to Be Sold as af.d will as afs.d sell and Convey and the Purchase Money thereby arising will receive pay and apply and the Overplus aforesaid if any to him the said John Welsh will pay in Manner aforesaid In Witness whereof the Parties to these Presents have hereunto interchangeably Set their Hands and Affixed their Seals the Day and year first above Written Signed Sealed and Delivered the words Jn.o Welsh (Seal) (and the same convey to the Purchaser or Purchasers Tho.s Rutland (Seal) in Fee being first interlined in the Presence of Henry Hall Th.s Watkins On the back of the aforegoing Deed was thus Indorsed to wit Received on the day and year first within written of and from the within Named Thomas Rutland the Sum of Seventy five Pounds Current Money of Pensylvania being the Consideration within Mentioned to be by him Paid to me I say received by Jn.o Welsh Witness Henry Hall Th.s Watkins On this 25.th Day of January 1769 Came before us the Subscribers two of his Lordships Justices of the Peace for Ann Arundel County John Welsh Party to the within Deed and Acknowledged the within Instrument of Writeing to be his Act and Deed and the Lands within Mentioned with their Appurtenances to be the Right and Estate of the within Named Thomas Rutland his Heirs and Assigns for ever according to the true (Intent) |
