(515) or in any wise Appertaining and the Revertion and Revertions Remainder and Remainders Rents Issues and Profits thereof and of every Part and Parcel thereof and all the Estate Right Title Interest Use trust Property Claim and Demand both in Law and in Equity of him the said John Welsh Party hereto of in and to the same and every or any part or Parcel thereof To have and to hold the said Tracts Parcels and Parts or pieces of Tracts or Parcels of Land and Premisses with their and each and every of their Rights Members and Appurtenances to him the said Thomas Rutland and his Heirs to and for the Uses Intents and Purposes herein after Mentioned and Expressed that is to say that he the sid Thomas Rutland and his Heirs to and for the Uses Intents and Purposes herein after Mentioned and Expressed that is to say that he the said Thomas Rutland shall and will upon his Receit of all Monies due and to grow due upon the Contract of Sale made by the said Benjamin Welsh of the said part of the aforesaid Tract of Land called the Resurvey on Ridgway's Farm make over and Convey the same agreeable to the said Contract and that he the said Thomas Rutland shall and will within a short and reasonable time Assign In severalty by Metes and Bounds to Ann Welsh widow of the said Benjamin Welsh one Just and Equal third Part of and in the Several and respective Other Lands and Tenements aforesaid to be holden by her the same Ann during her Life in Severalty as and for her dower of and in the Lands and Tenements afs.d of the Endowment of the afs.d Benjamin Welsh her said Late Husband and after the death of the aforesaid Ann then the said one Just and Equal third Part aforesaid to him the said Thomas Rutland his Heirs and Assigns to the only Proper Use and Behoof of him the said Thomas Rutland his Heirs and Assigns forever and to or for no Other Use Intent or Purpose whatsoever and as to Touching and Concerning the Residue of the Premisses In Trust and to the Intent and Purpose that he the said Thomas Rutland shall and will as soon as Conveniently may be and after Six Weeks at Least Public Notice thereof in the Maryland Gazette Set up and Expose to Sale by way of Public Vendue on the Premisses the remaining two third Parts of all and each and every of the said Lands with the said Benjamin Welsh at the time of Making the said Mortgage or at the time of his death had any Right or Title as also the remaining two third Parts of the said Tract of Land called Cheney Hill and the remaining two third Parts of any Other Lands of which the said Benjamin Welsh died Seized and the same Convey to the Purchaser or Purchasers in Fee and the Produce or Purchase Money arising from such Sales shall and will receive and apply in or towards the Payment Satisfaction and Discharge of the Debts which the said Benjamin Welsh did give at the time of his death (and if) |
