(514) to hold the same to my said two Sons Thomas and Benjamin Severally and to their Several and respective Heirs and Assigns forever and whereas the said Benjamin Welsh died Intestate without having Paid any thing on the said Mortgage and also greatly indebted on Bonds and Otherwise not Leaving Personal Estate Sufficient to Pay and discharge his debts and Administration of his Personal Estate hath been granted to the afs.d Thomas Rutland who hath returned an Inventory of great Part of the Personal Estate of the said Benjamin Welsh into the Prerogative Office amounting to Eleven hundred and Eighty three Pounds Nineteen Shillings and three Pence Maryland Currency including therein the Several Negroes Mentioned in the said recited Deed of Mortgage and their Increase except Negro Rachel who was the Property of the said Thomas Rutland as he doth Alledge and hath not only Paid some of the debts of the said Benjamin Welsh but hath also taken an Assignment of the said Mortgage to himself And Whereas the said Benjamin Welsh died Seized of a Tract of Land Lying in Ann Arundel County called Cheney Hill and also of part of another Tract of Land lying in Frederick County called the resurvey on Ridgway's Farm which same Part of the Tract of Land Last Mentioned the said Benjamin Welsh in his Lifetime Sold to Moses Barney and James White but the Land is not Conveyed nor the Purchase Money Paid Now this Indenture Witnesseth that the said John Wesh for and in Consideration of the Sum of Seventy five Pounds Current Money of Pensylvania to him in hand Paid by the said Thomas Rutland at or before the Sealing and Delivery of these Presents the Receit whereof he doth hereby Acknowledge and thereof and therefrom doth hereby release acquit and discharge the said Thomas Rutland his Heirs Executors Adm.rs and Assigns and every of them by these Presents Hath given granted bargained Sold Aliened remised and released and by these Presents Doth give grant bargain sell Alien remise and release to him the said Thomas Rutland his heirs and Assigns forever all and each and every of the said Tracts and Parcels and parts or Tracts or parcels of Land in the said recited Deed of Mortgage Mentioned also the said Tract of Land Called Cheney Hill and also the said Part of the Tract of Land aforesaid called The Resurvey on Ridgway's Farm and likewise all Other Tracts pieces or Parcels of Land whereof the aforesaid Benjamin Welsh died Seized Together with all Buildings Gardens Orchards Woods Ways Waters Improvements Previledges Advantages and Appurtenances whatsoever on the said Lands or any or either of them being to the same belonging (or) |
