(463) Joseph Mayo sall appear Gratis in his proper person or by his Attorney for that purpose lawfully constituted and shall Vouch to Warranty the said Thomas Metcalfe who shall appear Gratis and enter into the said Warranty and Vouch over the Common Vouchee and all such further and other proceedings shall be had therein as are usual and requisite for the suffering and perfecting of Common Recoveries for Assurance of Lands And it is hereby declared by all the said parties to these presents and the True Intent and meaning of them and every of them and of these presents is that the said Common Recovery and every other Common Recovery to be had of the same premisses or of any part thereof in Manner aforesaid or in any other Manner and all and every the Recoveror and Recoverors in such Common Recoveries and his and their Heirs shall stand and be seised thereof to and for the use of him the said Joseph Mayo his Heirs and Assigns for ever and to and for the use of him the said Joseph Mayo his Heirs and Assigns for ever and to and for no other Use Intent or Purpose whatsoever In Witness whereof the said Thomas Metcalf hath hereunto fixed his Hand and Seal the Day and Year first afsd Sealed and Delivered in the presents of Thomas Medcalf (Seal) William Scott John Hall (Seal) On the Back of which Deed was thus Endorsed (to wit) Received on the Day and Year within written of the within Named Joseph Mayo the sum of one hundred and fifty pounds Sterling in full for the consideration of the within Deed Thomas Medcalf Test William Scott Then came the within named Thomas Medcalf before me the Subscriber one of his Lordships Justices of the Provincial Court and acknowledged the within Instrument of writing to be his Act and Deed and the Lands and premisses therein specifyed to be the Right and Estate of the within Named Joseph Mayo his Heirs and Assigns according to the true intent and meaning thereof Dan of S.t Tho.s Jenifer Recorded the 26.th Day of October 1768 10½ sides Examd This Indenture Tripartite made this sixth Day of Sept.r in the year of our Lord one thousand seven hundred and sixty eight Between Charles Manns of Baltimore County and Elizabeth his Wife and Ohme Meade Spinster of the same place Daughters and Coheirs of Joseph Meade late of Ann Arundel County deceased Eldest Son of Joseph Meade and Eleanor his Wife of the first part John Gresham of Kent County Gentleman of the second part and James Tilghman the third Esquire of the City of Annapolis Attorney at Law of the third part Whereas for the Docking barring & extinguishing all Estates Tail and Reversions and Remainders thereupon expectant or depending of and in the Land and Appurtenances herein after mentioned the said James Tilghman as Demandant is hereafter at the Request Cost and Charges of the said John Gresham to prosecute and sue out of his Lordships high Court of Chancery his Lordships Writ of Entry sur Disseisin en le post against him the said John Gresham returnable and to be Returned to the next Provincial Court at Annapolis on the third Tuesday of October next whereby the said James Tilghman is to demand against (him) |
