(461) to Warrant the premisses the said John Beale Howard and Blanch his Wife who shall likewise appear Gratis in their proper persons or by Attorney or Attorneys lawfully Authorized and shall and will enter into the Warranty and Vouch over to warrant the said premisses the Common Vouchee who shall thereupon appear and enter into the said Warranty and after Imparlance make Default and such other and further proceedings shall be therein so that one or more good and perfect Common Recovery or Recoverys with double Voucher shall and may be had suffered perfected and Executed in all things according to the usual Form of Common Recoverys with double Voucher for Assurance of Lands in such Case Used and Accustomed And it is hereby further Covenanted Concluded Granted Declared and fully Agreed by and between all the said partys to these presents that from and after the suffering and perfecting the said Recovery or Recoveries so as aforesaid or in any other Manner to be had suffered and perfected shall be and Enure and shall be adjudged Construed Deemed and taken and are and were meant and intended and are hereby declared to be and Enure to the Use of the said Daniel McGee and Sarah his Wife for and during their Lives and the Life of the Survivor and to the Heirs of the said Sarah and to no other use Intent or purpose whatsoever In Witness whereof the parties to these presents have hereunto Interchangeably set their Hands and Seals the Day and Year above Written Jn.o Beale Howard (Seal) Signed Sealed and Delivered Blanche Howard (Seal) in the presence of W.m Paca (Seal) NRuxton Gay, Benjamin Rogers, Geo Chalmers Daniel Magee (Seal) Sarah Magee (Seal) On the Back of the aforegoing Deed was thus Endorsed to wit/ Received the Day and Year within written of the within Named William Paca the sum of five shillings Sterling Money in full for the Consideration Money therein mentioned to be by him paid to Witness Benjamin Rogers John Beale Howard On the 25.th Day of October 1768 Came before me the Subscriber one of his Lordships Justices of the Provincial Court the within Named William Paca and John Beale Howard and Blanch his Wife and severally acknowledged the within Deed to be their respective Act and Deed and that the within mentioned premisses were the Right and Estate of the within mentioned Daniel McGee and Sarah his Wife their Heirs and Assigns forever to and for the uses Intents and purposes of the within Deed and according to the True Intent and meaning thereof And the said Blanch being by me Examined apart from and out of the hearing of her said Husband John Beale Howard did repeat as aforesaid and did further declare that she had by the within Writing Released and did hereby Release all her Right and Title to the within premisses and that she Executed the said Writing of her own free will and Consent without any Compulsion or threats from her said Husband or for fear of his displeasure NRuxton Gay Benjamin Rogers Recorded the 26.th Day of October 1768 |
