(460) said William Paca at or before the Ensealing or Delivery of these presents the receipt whereof the said John Beale Howard and Blanch his wife do and each of them doth hereby acknowledge have and each of them hath remised released and confirmed and by these presents do and each of them doth remise release and confirm unto him the said William Paca (in his actual possession now being by Virtue of an Indenture of Bargain and Sale to him thereof made by him the said John Beale Howard bearing Date the Day next before the Day of the Date of these presents for one whole Year commencing from the Day next before the Day of the Date thereof and by force of the Statute for transfering uses into possession) his Heirs and Assigns All that Eastermost Moiety or half part of a Tract of Land called Jerico divided from the West part of the said Land by a line drawn North and South through the Middle of the said Tract containing five hundred Acres of Land more or less together with all Messuages Edifices Buildings Gardens Orchards Ways Waters Water Courses Commoditys priviledges Improvements Emoluments Advantages and Appurtenances whatsoever to the said Moiety or half part of the said Tract of Land belonging or in any ways Appertaining and the Reversion and Reversions Remainder and Remainders Rents Issues and profits thereof and of every part and parcel thereof and all the Estate Right title Interest Use Trust property Claim and Demand whatsoever of them the said John Beale Howard and Blanch his Wife or either of them of in or to the said premisses or any part thereof to have and to hold the said Moiety or half part of the said Tract of Land and all and singular the premisses to him the said William Paca his Heirs and Assigns to the Intent and purpose that the said William Paca may be and become perfect Tenant of the Freehold and Inheritance of the said premisses that a Common Recovery may be had and Suffered against him in such Manner as is herein after mentioned and for that purpose it is hereby Covenanted Granted and Agreed by and between all the parties to these presents that before the End of the next October Provincial Court one or more Writ or Writs of Entry Sur Disseisin en le post at the Costs and Charges of them the said Daniel McGee and Sarah his wife shall and may be brought and prosecuted against him the said William Paca in the Name of them the said Daniel McGee and Sarah his wife as Plaintiffs or Demandants therein of and for the aforesaid Moiety or half part of the said Tract of Land and premisses with the Appurtenances by such Name or Names Quantity Quality Number or Content of Acres or other Certainties Descriptions as shall be apt and convenient in that behalf to which Writ or Writs the said William Paca shall appear Gratis in his own proper person or by his Attorney or Attorneys lawfully Authorized and shall Vouch (to) |
