(441) Money arising by such Sale demand recover and receive from the respective purchasors thereof and apply the same to the payment and discharge of the said Sum of Seven hundred and forty two pounds five Shillings Sterling Money and legal Interest thereon and the Charges of drawing and recording this Writing and Legal Interest thereon until the same Sum of Money and Charges with Legal Interest shall be fully satisfied discharged and paid and the Lands and premisses aforesaid and every part and parcell thereof with the Appurtenances so set up and exposed to Sale as aforesaid effectually Convey to the respective purchasor or purchasors thereof and that he the sid Robert Horner his Heirs Executors Administrators and Assigns shall and will upon request of such purchasor or purchasors as aforesaid make execute levy suffer and give to such purchasor or purchasors their Heirs and Assigns respectively a good firm and sufficient release or other such effectual Deed as shall be required of and for any of the said Premisses so bought at Vendue by such respective purchasor or purchasors as aforesaid and in case there shall not be a sufficient Sum of Money arising from such Sale or Sales as aforesaid to discharge and pay the said Sum of Seven hundred and forty two pounds five Shillings Sterling Money and the Charges of drawing and recording this Writing with the Legal Interest as aforesaid that then the said Robert Horner his Heirs Executors and Administrators shall and will pay and Satisfy to the said John Crosbie and William Crosbie their Heirs Executors Administrators and assigns the Dificiency with Legal Interest thereon In Witness whereof the said Robert Horner hath hereunto set his Hand and affixed his Seal the day and year first above Written Signed Sealed and Delivered in the presence of us Rob.t Horner (Seal) J Rogers James Kirk On the Back of the aforegoing Deed was thus Indorsed to wit Received on the Day and year first within Written of and from the within Named John Crosbie and William Crosbie the sum of seven hundred and forty two pounds five shillings Sterling Money being the Consideration Money within mentioned to be paid by them to me received by me Witness Rob.t Horner J Rogers James Kirk On the twenty sixth day of August in the year Seventeen hundred and Sixty eight Came the within Named Robert Horner before me the Subscriber one of his Lordships Justices of the provincial Court and Acknowledged the within Instrument of Writing to be his Act and Deed and the Lands and premisses therein Mentioned and every part and parcell thereof to be the right and Estate of the within Named John Crosbie and William Crosbie their Heirs and Assigns according to the true intent and meaning of the same Writing and the Act of Assembly in such Cases made and provided Before J Hepburn 5½ Recorded the 27.th day of August 1768 |
