(440) or Administrators shall and will well and truly pay or Cause to be paid to them the said John Crosbie and William Crosbie their Heirs Executors Administrators or Assigns the aforesaid sum of seven hundred and forty two pounds five Shillings Sterling Money aforesaid with Legal Interest thereon together with the Charges of drawing and recording this Writing and Legal Interest thereon at or upon the said thirteenth day of May which shall be in the year Seventeen hundred and Seventy two without fraud or Delay and if default be made in the payment of the sid Sum of Seven hundred and forty two pounds five Shillings Sterling Money and legal Interest thereon or any part or parcell thereof or in the payment of the Charges of drawing and recording this Writing and legal Interest thereon by the said Robert Horner his Heirs Executors and Administrators according to the Condition or proviso and Covenant for payment aforesaid then the said Robert Horner for himself his Heirs Executors Administrators and Assigns doth hereby Covenant Grant Promise and agree to and with the said John Crosbie and William Crosbie their Heirs Executors Administrators and Assigns in Manner and form following that is to say that they the said John Crosbie and William Crosbie their Heirs Executors Administrators or Assigns or the lawfull attorney ^or Attorneys^ or Substitute or Substitutes of them the said John Crosbie and William Crosbie their Heirs Executors Administrators or Assigns or the Survivor of them shall and May if he or they see fit at any time after the said thirteenth Day of May in the Year Seventeen hundred and seventy two and after giving three Weeks Notice thereof in the Maryland Gazette enter into the aforesaid two tracts or parcells of Land Called Keeth's Rest and Sympson's Chance or either or any part or parcell of either of them and premisses with the Appurtenances set up and expose to sale by way of public Vendue to the Best and highest Bidders in Sterling Money and the Money arising on Such Sale demand recover and receive of and from the respective purchasors thereof and the same Money so received apply to the payment and discharge of the aforesaid Sum of Seven hundred and forty two pounds five shillings Sterling Money and legal Interest thereon and the Charges of drawing and recording this writing and legal Interest thereon and in Case the Money arising by such sale of the said two tracts or parcells of Land Called Keeth's Rest and Sympsons Chance shall not be Sufficient to pay and discharge the said Sum of Seven hundred and forty two pounds five Shillings Sterling and Legal Interest thereon and the Charges of drawing and recording this writing and legal Interest thereon then the said John Crosbie and William Crosbie their Heirs Executors Administrators or Assigns or their Attorney or Attornies or substitute or substitutes or the surviver of them as aforesaid shall and May set up and expose to sale in Like Manner the rest and residue of the Lands and premisses herein before mentioned and hereby Bargained and Sold or any or either of them or any part or parcell of them or any or either of them to the best and highest bidder and the (Money) |
