(439) Conveyed by a certain John Jordon to the aforesaid Robert Horner And also all that tract or parcell of Land Called Simpson's Chance Lying and being in Charles County aforesaid Containing and laid out for one hundred and eighty Six Acres of Land more or Less granted to a Certain Ignatius Sympson and by him Sold and Conveyed to the aforesaid Robert Horner Together with and Singular the houses out houses Edifices Buildings Gardens Ways Waters Water Courses Commodities Priviledges and Advantages Premisses and Appurtenances to the Same Several tracts or parcells of Land and each and every of them belonging or Appurtaining And the Reversion and Reversions remainder and remainders Rents Issues and Profitts thereof and of every part and parcell thereof and Premisses with the Appurtenances and also all the Estate Right Title Interest use Trust profitt property Claim and Demand whatsoever of him the said Robert Horner of into and out of the severall tracts or parcells of Land aforesaid and each and every and every part and parcell of Each and every of them and premisses with the Appurtenances To have and to hold one undevided Moiety of the said several tracts and parcells of Land and Premisses with the Appurtenances and every part and parcell thereof to him the said John Crosbie his Heirs and Assigns to the only proper use and Behoofe of the said John Crosbie his Heirs and assigns for ever And to have and to Hold the other undevided Moiety of the said Several tracts and parcells of Land and Premisses with the Appurtenances and every part and parcell thereof to him the said William Crosbie his Heirs and Assigns to the only proper use and Behoofe of him the said William Crosbie his Heirs and Assigns forever as tennants in Common and not as Jointenants And the said Robert Horner for himself his Heirs Executors and Administrators doth hereby Covenant Grant Promise and agree to and with the said John Crosbie and William Crosbie their Heirs and and Assigns that he the said Robert Horner and his Heirs the Several tracts and parcells of Land aforesaid and each and every and every part and parcell of each and every of them and Premisses with the Appurtenances from by and against him the said Robert Horner and his heirs ^and from by^ and against all Manner of person and persons whatsoever Claiming or which Shall or may at any time hereafter Claim the same or any part or parcell thereof to them the said John Crosbie and William Crosbie and their Heirs and Assigns shall and will forever hereafter Warrant and Defend by these presents Provided always upon Condition that if the said Robert Horner his Heirs Executors Administrators or Assigns do and shall well and truly pay or Cause to be paid to them the said John Crosbie and William Crosbie their Heirs Executors Administrators or Assigns the aforesaid sum of seven hundred and forty two Pounds five Shillings Sterling Money aforesaid with Legal Interest thereon together with the Charges of Drawing and recording this Writing and legal Interest thereon at or upon the thirteenth day of May which shall be in the year Seventeen hundred and Seventy two then this Indenture and every Clause and Article therein to be void and of none Effect And the said Robert Horner for himself his Heirs Executors and Administrators doth hereby Covenant Grant promise and agree to and with the said John Crosbie and William Crosbie their Heirs Executors and Administrators that he the said Robert Horner his Heirs (Executors) |
