(394) land called Prevention running thence East south East thirty three and One half perches to the line of the Land Mortgaged by James Greenfield to Thomas Truman Greenfield then with said line North East by North ninety five perches then south twenty nine degrees East twenty perches and one half perch to the line of the tract of land called Freemans hill, thence with the said land North thirty one degrees and a half East eighty Seven perches and a half to the beginning of the given line of pheasants hills then with the given line till it intersects such a line drawn Northerly from the beginning as will divide Pheasants hills in two equall Quantitys exclusive of Eleven Acres Included in a mortgage from James Greenfield to Thomas Truman Greenfield as by the said deed of partition references being thereto had may fully and at large Appear Now this Indenture Witnesseth that the said Joshua Beall and Eleanor his wife for and in Consideration of the Sume of five Shillings Sterling Money of Great Britain to them in hand by the said George Beall at or before the Sealing ^and delivery^ of these presents the receipt whereof is hereby Acknowledged and for the docking barring and extinguishing all Estates Tail and all Reversions and Remainders thereupon expectant or depending of and in the Lands Tenements and hereditaments herein aftermentioned they the Joshua Beall and Eleanor his wife (by and with the advice and Consent of the said John Hall testify'd by his being party to and his Sealing and Executing these presents) Hath Granted bargained and sold aliened released and Confirmed and by these presents doth Grant bargain sell alien release and Confirm unto him the said George Beall (In his Actuall possession now being by virtue of a bargain and Sale to him thereof made by the said Joshua Beall and Eleanor his wife bearing date the day next before the date of the date of these presents for one whole year Commencing from the day next before the day of the date thereof and by force of the Statute for Stransferring uses into possession) his heirs and Assigns the aforesaid two parts of the said tracts of land Called pheasants hills and Freemans hill particularly described as above to be laid out and Appointed by Agreement as aforesaid for the same Joshua Beall and Eleanor his wife together with all Edifices Gardens Buildings Orchards ways Waters Water Courses Commodities priviledges Improvements Emoluments Advantages and Appurtenances whatsoever to the same parts of the tracts of land aforesaid belonging or Appurtaining And the Reversion and Reversions Remainder and Remainders Rents Issues and profits thereof or any part thereof And all the Estate Right Title Interest use trust property Claim and Demand whatsoever of them the said Joshua Beall and Eleanor his wife of into or out of the Aforesaid parts or tracts of lands aforesaid or any part thereof To have and to hold the said parts of the tracts of land and all and Singular the premisses with the rights members and Appurtenances to him the said George Beall his heirs and Assigns to the Intent and purpose that the said George Beall may be and become perfect tenant of the freehold and Inheritance of the said premises that a common recovery may be had and Suffered against him in Such manner as is herein Aftermentioned and for that purpose it is hereby covenanted granted and Agreed by and between all the said parties to these presents that before the end of the next Provincial Court one or more writt or writts of entry Sur Desseisin enlepost at the Cost and Charges of them the said Joshua Beall and Eleanor his wife Shall and may be brought and prosecuted against him the said George Beall in the name of him the said John Hall as plaintiff or demandant therein and for |
