(352) and whereas Upton Scott Executor of the said Edmund Key did upon setting forth the above Tracts and paying the usual Caution Money for the vacant Land obtain his Lordships Grant of Confirmation bearing date the fifth Day of August seventeen hundred and sixty six for the said two Tracts of Land called Paradise and Good Hope in Trust for the Benefit of the said Edmund Keys Estate and to Effectuate the purposes of his Will and whereas the said Upton Scott hath according to the Directions of the said will sett up to Sale at Publick Vendue the said Three Tracts of Land called Friendship Paradise and Good Hope and Francis Key and Normand Bruce were the highest Bidders for the same Now this Indenture Witnesseth that the aforesaid Upton Scott Executor of Edmund Key Esq.r Deceased for and in Consideration of the premisses and also of the sum of Four hundred and one Pounds sterling to him in hand paid by the said Francis Key and Normand Bruce at or before the Sealing and Delivery of these presents (the Receipt whereof is hereby acknowledged by the said Upton Scott) hath bargained sold aliened and conveyed and doth by these presents bargain sell alien and convey unto the aforesaid Francis Key and Normand Bruce all his the said Upton Scotts Estate Right Title Interest Claim and demand whatsoever in or to the above three Tracts of Land called Friendship containing by Patent two hundred and six acres Paradise containing three hundred and thirty five acres and Good Hope containing three hundred acres all three situate lying and being in Frederick County together with all and singular their Appurtenances To have and to hold the said Three Tracts of Land called Friendship Paradise and Good Hope with their Appurtenances described ^above^ to them the said Francis Key and Normand Bruce their Heirs and Assigns for ever And the said Upton Scott for himself his Heirs Executors Administrators and Assigns doth covenant promise and agree to and with the said Francis Key and Normand Bruce their Hairs and Assigns that he the said Upton Scott his Heirs Administrators or Assigns will at any Time hereafter upon the reasonable request of them the said Francis Key and Normand Bruce their Heirs or Assigns execute and perform any Act or Assurance that they or their Counsel learned in the Law shall advise for the purpose of vesting in them the said Francis Key and Normand Bruce their Heirs and Assigns all the Right title and Interest remaining in him the said Upton Scott by virtue of the last will and Testament of Edmund Key Esq.r Deceased or (any) |
