(351) 1767 Decem.r 4.th Rece.d of M.rs Jane Ayton the sum of five shillings Sterling for the use of Lord Baltimore being the alienation from Edward Loyd Esq.r his said Lordships Agent and receiver General J Brice Recorded the 4.th Day of December 1767 8¾ sides Ex.d This Indenture made this twenty second Day of October in the Year of our Lord one thousand seven hundred and sixty seven Between Upton Scott of the City of Annapolis Physician and Executor of the last Will and Testament of Edmund Key late of the City of Annapolis Esq.r Deceased of the one part and Francis Key of Cecil County and Normand Bruce of Frederick County Gentlemen of the other part Whereas Edmund Key late of the City of Annapolis Esq.r did by his Last Will and Testament bearing date the twenty sixth Day of April seventeen hundred and sixty six give and bequeath unto Doctor Upton Scott all his Estate both real and personal in Trust for certain uses and purposes therein expressed as by the said Bill lodged in the Prerogative Office of this Province relation being thereunto had may more fully appear And Whereas Philip Key late of Saint Marys County ^Esq.r^ did by his Last Will and Testament bearing date the tenth Day of March seventeen hundred and sixty four give unto the said Edmund Key by the Name and Description of his Son Edmund Key and his Heirs for ever as by the said Will lodged in the Prerogative Office relation being thereunto had may more fully appear Two Tracts of Land both lying in Frederick County the one called Paradise regained containing five hundred and thirty acres and the other called Friendship containing two hundred and six Acres and whereas the said Philip Key obtained a special warrant out of his Lordships Land Office to Resurvey the said Tract of Land called Paradise regained and whereas the surveyor on runing out the said Land discovered that it run into Elder Surveys and was divided into three parts to the first part of which containing two hundred and thirty six Acres and the second part containing eight Acres he added ninety one Acres of vacant Land and reduced the whole into one Tract called Paradise containing Three hundred and thirty five Acres and to the third part containing thirteen Acres he added two hundred and eighty seven Acres of vacant Land and reduced them into one other Tract called Good Hope containing three hundred Acres and returned Certificates of the same into the Land Office and whereas neither Philip Key Esq.r nor Edmund Key Esq.r his son did in their Life Time obtain his Lordships Grant of Confirmation for the above two Tracts of Land called Paradise and Good Hope (and) |
