(339) Tract or parcel of Land aforesaid and premisses with the Appurtenances and of in to and out of every part and parcel thereof To have and to hold the same undivided moiety or half part of the Tract or parcel of Land aforesaid and every part and parcel thereof and premisses with the Appurtenances to him the said Walter Dulany his Heirs and Assigns to the only proper use and Behoof of him the said Walter Dulany his Heirs and Assigns forever and to or for no other use Intent or purpose whatsoever And the said Charles Carroll Junior for himself his Heirs Executors and Administrators doth hereby covenant grant promise and agree to and with the said Walter Dulany his Heirs and Assigns that he the said Charles Carroll Junior and his Heirs the said undivided moiety or half part of the Tract or parcel of Land aforesaid and every part and parcel thereof and premisses with the Appurtenances to him the said Walter Dulany and his Heirs and Assigns from by and against him the said Charles Carroll Junior and his heirs and all manner of person or persons whatsoever claiming from by or under him or them shall and will warrant and for ever defend by these presents In Witness whereof the said Charles Carroll Junior hath hereunto set his Hand and affixed his seal the Day and Year first above written signed Sealed and Delivered Charles Carroll Jun.r (seal) in the presence of us J Hepburn John Hepburn J.r Received on the Day and Year first within written of and from the within named Walter Dulany the sum of twelve hundred and fifty Pounds sterling Money of Great Britain being the Consideration Money within mentioned to be paid by him to me received by me Charles Carroll Jun.r Witness J Hepburn On the 19.th day of Oct.r in the Year seventeen hundred and sixty seven Came the within named Charles Carroll Junior before me the subscriber one of his Lordship the Right Honorable the Lord Proprietary of Maryland his Justices of the Provincial Court of the same Province and acknowledged the within Instrument of writing to be his Act and Deed and the undivided moiety or half part of the Tract or parcel of Land within mentioned and every part and parcel thereof and Premisses with the Appurtenances to be the only right and Estate of the within named Walter Dulany his Heirs and Assigns according to the true intent and meaning of the same writing At the same Time also personally appeared before me (Mary) |
