(324) Whereby the said Samuel Chase shall and may demand against the said Jeremiah Townly Chase all and singular the aforementioned premisses with the Appurtenances by such Name or Names Quantity or Quantities Quality or Qualities Number or Contents of Acres as shall be thought fitt and requisite unto which said writ or writs the said Jeremiah Townly Chase shall appear in proper person and shall vouch to warranty the said Thomas Sheredine and Ann his wife and the aforesaid John Cromwell who shall appear gratis upon the voucher and shall enter into warranty and shall vouch over to warranty the Common vouchee and the Common vouchee shall appear and imparle and afterwards make default whereby one or more Recovery or Recoveries Judgment or Judgments may be had and given for the said Samuel Chase for Recovery of the said Tract or parcel of Land called South Conton and premisses with the Appurtenances against the said Jeremiah Townly Chase And for the said Jeremiah Townly Chase to recover over in value against the Common vouchee according to the manner and form of Common Recoveries in such cases uses And it is further Covenanted granted Concluded agreed and declared by and between all and every the said parties to these presents and the true intent and meaning of the said parties to these presents is that from and immediately after the said Common Recovery or Recoveries shall be had prosecuted and suffered as aforesaid of the said Land and premisses the said Recovery or Recoveries shall be and enure and shall be Construed esteemed adjudged and taken to be and enure and are hereby declared to have been intended to be and enure That the said Samuel Chase and all and every other person and persons who shall be seised of the Land and premisses aforesaid or any part thereof by force and Virtue of the said Common Recovery or Recoveries shall stand and be seised thereof and of every parcel thereof with their and every of their Appurtenances to the only use and behoof of the said John Cromwell his Heirs and Assigns for ever and to no other use intent or purpose whatsoever In Witness whereof the said parties to these presents have hereunto set their Hands and seals the Day and year First above Written T Sheredine (seal) Sealed and Delivered Anne Sheredine (seal) in presence of W.m Harwood Mary e John Cromwell (seal) On the Back of the aforegoing Deed was thus endorsed to wit Received the Day of the within written Indenture by us respectively the sums of five (Shillings) |
