       of the said small branch until it intersects the give line of the said Tract
       of Land it being the same parcel of Land which was heretofore devised by the
       aforesaid Stephen Cawood to the aforesaid John Cawood in Tail Together with all
       Edifices Buildings Gardens Orchards ways waters water Courses Commodities
       priviledges Improvements Emoluments Advantages and Appurtenances whatsoever
       to the same parcel of Land belonging or appertaining and the Reversion and Reversions
       Remainder and Remainders Rents Issues and profits thereof and of every part and
       parcel thereof and also all the Estate Right title Interest use Trust property claim
       and demand whatsoever of him the said John Cawood of into and out of the same
       part of the tract or parcel of Land aforesaid  To have and to hold the said part of the
       Tract or parcel of Land aforesaid and premisses with the Appurtenances to him
       the said James Marshall his Heirs and Assigns forever  To the intent and
       purpose that the said James Marshall may be and become perfect Tenant of
       the Freehold and Inheritance of the said premisses that a common Recovery may be had
       and sufferd against him in such manner as is herein after mentioned and for that
       purpose it is hereby covenanted granted and agreed by and between all the said
       Parties to these presents that before the end of the next Provincial Court one or more
       writ or writs of Entry sur Disseisin en le post at the Costs and Charges of him
       the said James Marshall shall and may be brought and prosecuted against him
       the said James Marshall in the name of him the said Benjamin Cawood the son
       as Plaintiff or Demandant therein of and for the aforesaid part of the tract or
       parcel of Land aforesaid with the Appurtenances by such name or names Quantity
       Quality Number or content of Acres or other certainties and Descriptions as
       shall be apt and convenient in that Behalf  To which Writ or Writs the said
       James Marshall shall appear Gratis in his proper person or by his Attorney or
       Attornies lawfully Authorized and shall vouch to warrant the premisses the said
       John Cawood who shall likewise appear gratis in his proper person or by Attorney or
       Attornies lawfully Authorized and shall and will enter into the said Warranty and
       vouch over to warrant the same premisses the common Vouchee who shall thereupon
       appear and enter into the said warranty and after imparlance make default and
       such further and other Proceedings shall be therein so that one or more good and perfect
       common Recovery or Recoveries with double voucher shall and may be had suffered
       perfected and executed in all things according to the usual form of common Recoveries
      with Double voucher for Assurance of Lands in such case used and accustomed And
       it is hereby further covenanted concluded granted declared and fully agreed by and between
