(315) presents have hereunto interchangeably set their Hands and affixed their seals the Day and Year first above written his Signd sealed and Delivered in the presence of us John Cawood (seal) J Hepburn G Scott Mark James Marshall (seal) Received on the Day and Year first within written of and from the within named James Marshall the sum of five shillings sterling Money being the Consideration Money within mentioned to be by him paid to me I say received by me his Witness J Hepburn John I Cawood Recorded the 22.d Day of October 1767 7 sides Ex.d This Indenture Tripartite made this thirtieth Day of September in the Year of our Lord seventeen hundred and sixty seven Between John Cawood of Frederick County in the Colony of Virginia planter son and Devisee of Stephen Cawood late of Charles County in the Province of Maryland deceased of the one part and James Marshall of Prince Georges County in the Province of Maryland Merchant of the second part and Benjamin Cawood son of the said John Cawood of Charles County in the Province of Maryland planter of the third part Witnesseth that the said John Cawood for and in consideration of the sum of one hundred and ten Pounds Current Money to him in hand paid by the said James Marshall at or before the sealing and Delivery of these presents paid the receipt whereof is hereby acknowledged and for the Docking barring and extinguishing all Estates Tail and all Reversions and Remainders thereupon expectant or depending of and in the Lands Tenements and Hereditaments herein after mentioned he the said John Cawood (by and with the advice and consent of the said Benjamin Cawood the son testified by his being a Party to and his sealing and executing these presents Hath granted bargained sold aliened released and confirmed and by these presents Doth grant bargain sell alien release and confirm unto him the said James Marshall (in his actual possession now being by virtue of a bargain and sale to him thereof made by him the said John Cawood bearing Date the Day next before the Day of the Date of these presents for one whole Year commencing from the Day next before the Day of the Date thereof and by force of the statute for transferring uses into Possession) his Heirs and Assigns all that part of a Tract or parcel of Land called Hull lying and being in Charles County aforesaid that is to say so much of the said Tract as shall be contained at the Eastermost end of it as shall be divided by a small branch Westerly from the Dwelling House about sixty yards and to run as the said Branch goes tending into Mattawoman Main run and over the said run with a streight line from the Mouth of |
