(237) appraised by ^some^ good and lawfull Men of the same Sheriffs Bailiwick and Delivered to the said Stephen west according to the ^form of the^ Statute in such Case made and provided and also the Act of Assembly of this Province and the usage and Practice that hath thereupon obtained which said Execution of the said writ or Precept on the Return thereof was moreover by the Award of the said Provincial Court Affirmed and established as by Relation being had to the said writ or Precept the Return thereof and the Appraisement and Schedule in the said Return mentioned among the Records and Proceedings of the said Provincial Court may more fully appear and whereas on or about the eighteenth of September in the year of our Lord Seventeen hundred and Sixty five the said Stephen West In Consideration of the Sum of two hundred and thirty pounds Sterling to him in hand paid by the said Daniel Dulany did by his certain Agreement to and with the said Daniel Dulany in writing promise and agree to give grant and convey unto him the said Daniel Dulany and his heirs to and for his and their proper use and Behoof the aforesaid Tract of Land the same being called and Known by the Name of Dickson's Struggle containing by Estimation two hundred and twenty nine Acres also obliging himself and his heirs that his the said Stephen West his wife Should and would join in Such Gift Grant and Conveyance in order and for the Purpose to bar and extinguish all Right and claim of Dower in and to the said Land and every part thereof and moreover by proper and sufficient Covenant & Covenants to defend the said Land and every part thereof to the said Daniel Dulany his heirs and Assigns against all Judgments Executions Extents and Loan Office Bonds which then did or Should or might affect the said Land or any part thereof and also that in Case the said Land should be fraud to contain a less Quantity than that of two hundred and twenty nine Acres to return and refund to the said Daniel Dulany a Sum of money for ever Acre and Proportion of an Acre which the said Land should be found to be short of the aforesaid full Quantity aforesaid in Proportion as such Deficiency should bear to the full Quantity aforesaid Now this Indenture witnesseth that as well for and in Consideration of the Premisses as of the Sum of five Shillings to him the said Stephen West in hand paid by the said Daniel Dulany at or before the Sealing and Delivery of these Presents the Receipt whereof is hereby fully acknowledged he the said Stephen West hath given granted bargained and ^sold^ released and confirmed and by these presents doth give grant bargain and sell release and confirm unto the said Daniel Dulany all the tract of Land aforesaid with the Appurtenances containing by Estimation two hundred and twenty nine Acres and called or known by the name of Dicksons Struggle scituate lying and being in Frederick County near unto Frederick Town and the Reversion and reversions Remainder and Remainders Rents issues and Profits of the Premisses and every part and parcel thereof and also all the Estate Right Title Interest claim and Demand whatsoever of him the said Stephen West of in or out of the Premisses on any Part or Parcell thereof To have and to hold all and Singular the Premisses unto him the said Daniel Dulany his heirs and assigns forever to and for his and their proper use and Behoof and |
