(236) doth out of the hearing of her said Husband as aforesaid answer in the Affirmative And doth acknowledge the Same Indenture to be her Act and Deed willingly and freely and without being induced thereto by the fear or threats of or ill usage ^by^ of her said Husband or fear of his displeasure Will.m Aisquith 7½ sides Recorded the 5.th day of June 1767 Benjamin Rogers Ex.d I Tobias Butler do swear that I will not for Lucre or Malice delay any Person or Persons Applying to me for any Business belonging to the Office I Officiate in and that I will not Directly or indirectly ask demand take or receive from or charge to any such person or persons to my own use (Except my Salary from my principal) any Fee or Reward whatsoever for any Service I shall do as Clark of the said Office, and also that in making out the Office fees, I will not wittingly or willingly Charge other or higher fees than Limited by the Act Entituled an Act for Amending the Staple of Tobacco for preventing frauds in his Majestys Customs and for Limitation of Officers fees. June 9.th 1767 Sworn before Rob.t Couden Recorded the 9.th of June 1767 Ex.d This Indenture Made the twenty fifth Day of June in the year of our Lord One thousand seven Hundred and Sixty Seven Between Stephen West of Prince Georges County Merchant of the one Part and Daniel Dulany of the City of Annapolis Esquire Barrister at Law on the other Part Whereas the said Stephen West before the Justices of the Provincial Court recovered against James Dickson of Frederick County by the name of James Dickson late of Frederick County merchant otherwise called James Dickson of Fred.k County as well the Sum of thirteen Hundred and thirty four Pounds four Shillings Sterling a certain Debt as also the Sum of four Hundred and eighty seven Pounds and three Quarters of a Pound of Tobacco by the said Justices adjudged as well for the Damages sustained by the said Stephen West by means of detaining that Debt as for his Costs and Charges of Suit or some other large Sums of Money & Tobacco as by relation being had to the Records and Proceedings of the said Provincial Court and particularly to the Records and Proceedings of the said Court on or about the Second Tuesday of September in the year Seventeen hundred and Sixty four and whereas upon the said Judgment by the Award of the said Provincial Court the said Stephen West did obtain a certain writ or Precept directed to the Sheriff of Frederick County commanding him that of the goods and Chattels Lands and Tenements of the said James Dickson he would cause to be made as well the Debt aforesaid as the Damages Costs and Charges aforesaid whereof the said James Dickson was convict as aforesaid and whereas the Sheriff aforesaid to wit George Murdock by virtue of the said writ of Execution did cause to be made of the Lands of the said James Dickson to wit the Tract of Land herein after granted the Sum of two hundred and twenty nine pounds Sterling the said Tract of Land being taken and appraised |
