(229) true and lawfull Owner of the Land's with the appurtenances afs.d and standeth Seized of an absolute Estate of Inheritance in Fee Simple in the Same and hath a Good Right and authority to sell and dispose of the same in manner and form as afs.d and further more he the said Walter Pumphery and his heirs &c doth Covenant Grant and Agree to and with the said Charles Hammond Jun.r that he the said Walter Pumphery and his heirs the af.d Premisses with the Appurtenances af.d from and against him and them and all persons claiming under them unto him the said Charles Hammond Jun.r and his heirs shall and will forever hereafter warrant and Defend by these presents and that he will do or suffer to be done any other acts or things and will Execute and Acknowledge any other Instrument of writing for the better Surety and sure making of the Premisses with the Appurtenances af.d unto him the said Charles Hammond Jun.r and his heirs as shall be reasonably devised advised or required In Witness whereof the said Walter Pumphery hath hereunto set his hand and seal the day and year first above Written his Signed Sealed and Delivered Walter W Pumphrey (seal) in the presence of us mark The word "Covenants" in the 27.th Line being first Inserted Joshua Griffith Jn.o Hammond On the Back of the Aforegoing Deed was thus Written viz.t 1767 May 29.th Then Received of Charles Hammond Jun.r the sum of One hundred Cur.y and Seventy Pounds Current Money being the consideration within mentioned £170 0 0 Testes his Joshua Griffith Walter W Pumphrey mark 1767 May 29.th Then Came Walter Pumphrey Party to the within Deed before us the Subscribers two of his Lordships Justices of Ann Arundel County Court and acknowledged the same to be his Act and Deed and the Land and Premisses with the appurtenances therein Expressed to be Bargained and Sole to be the Right and Estate of the within named Charles Hammond Jun.r his heirs and Assigns forever according to the true intent and meaning of the said Deed and of the Act of Assembly in such case made and provided And at the same time came Rachel the wife of the said Walter Pumphrey and being privately Examined out of the hearing of her said Husband Declared that she freely and willingly gave up all her Right Title Interest and Dower of in and to the said Land and Premisses with the Appurtenances unto him the said Charles Hammond Jun.r his heirs and Assigns forever without any fear of the threats or Displeasure of her said Husband acknowledged before us the Day and year first above written John Burgess Jun.r H Ridgley June 1.st 1767 Received of M.r Charles Hammond Junior the Sum of five Shillings Sterling Money for use of the Lord Proprietary it being the Alienation fine on the within Lands by virtue of a Commission from Edward Loyd Esq.r his Said Lordships Agent and Receiver General Jn.o Brice 11½ Sides Recorded the 1.st June 1767 |
