(224) said John West and for the said John West to recover in value against the said common vouchee to the End one perfect common Recovery with Single voucher may be thereupon had and suffered and all and every other thing and things be done and perfected needfull and convenient for the having and suffering the same Recovery according to the course of common Recoveries in such cases used and the same Recovery as also to be executed by one writ of habere facias seisinam accordingly And it is hereby further covenanted concluded and agreed by and between all the said Parties to these Presents for themselves and every of them their and every of their Heirs that the said Recovery so as aforesaid or in any other Manner to be had and suffered of the said Tenements with the appurtenances shall be and enure and shall be deemed adjudged and taken and is meant and intended and by all the said Parties to these presents is hereby declared to be and enure and the said Benjamin Rumsey and his heirs from and immediately after the suffering the same shall Stand and be seised of all and singular the said Tenements and Premisses with the appurtenances above mentioned and every part and parcell thereof to and for the only proper use and Behoof of the said John West his heirs and Assigns forever and to and for us other use Intent or Purpose whatsoever In Witness whereof the Parties to these Presents have hereunto interchangeably set their Hands and Affixed their Seals the Day and Year first above mentioned Sealed and Delivered John West (seal) In the Presence of us Tho.s Sligh Vachel Worthington Benjamin Rumsey (seal) On the Back of the Aforegoing Deed was thus Written viz.t On this Twenty sixth Day of May before me the Subscriber One of his Lordships Justices of the Provincial Court comes the within John West and acknowledges the within Indenture to be his Act and Deed and desires the same may be recorded accordingly 6½ sides Recorded the 26 May 1767 B Hands Exam.d This Indenture Tripartite made this Second Day of April in the Year of our Lord One Thousand Seven Hundred and Sixty Seven between Henry Vanbebber late of Cecil County in the Province of Maryland but now of New Castle County in the Government of the Counties of New Castle Kent and Sussex on Delaware Gentleman of the first part John Neide of Cecil County in the Province of Maryland Merchant of the second Part and Benjamin Rumsey of the County and Province last aforesaid of the third Witnesseth that the said Henry Vanbebber for the Docking barring and cutting off all Estates Tail Remainders in Tail and couting out Remainders of and in all that one Hundred and Ninety two acres of plantable Land scituate lying and being on Bohemia River in Cecil County aforesaid and comprised |
