(223) at the said marriage and no other person except as above mentioned to the best of this Deponants Memory, That the said Stead Lowe and Letitia have since their marriage (to the day of his Death) been always deemed and reputed by their acquaintance and Friends to be Man and Wife that the said Stead Lowe always acknowledged the Same as this Deponant verily believes and that he never heard of any Person in this Province who entertained the least Doubt thereof This Deponant further declared that he knew the said Stead Lowe in England and all his Family that he was the Brother of the said John Lowe as above mentioned and that the said Stead Lowe came into the province of Maryland with this Deponant in the Year of our Lord 1747 And lastly this Deponant declares that the said Stead Lowe left one Child only by the said Letitia being a son who was baptized by the Name of Stead by the Rev.d M.r Henry Addison The Child is now in his Sixth Year and at present lived with the said Deponant and further ^this deponant^ saith not 2 Sides Recorded the 25 May 1767 B Hands Exam.d This Indenture made this second Day of April in the Year of our Lord one Thousand Seven hundred and Sixty seven Between John West of Baltimore County in the province of maryland Planter of the one Part and Benjamin Rumsey of Cecil County in the Province aforesaid of the other part Witnesseth that the said John West covenants and agrees to and with the said Benjamin Rumsey to dock barr and cutt off all Estates Tail and Remainders in Tail of and in all that One Hundred and Thirty Acres of Plantable Land Situate lying and being in Baltimore County in the Province aforesaid being part of a Tract of Land called Maidens Mount and contained within the lines following Beginning at the bounded Beeches of a Tract of Land called Maidens Mount and running up the said Branch to a bounded oak being the Second Tree of a Tract of Land formerly called Paradise but now Wests Addition then running from the said Tree south west by South Sixty perches then north thirty Degrees west two hundred Perches then with a streight line to the End of the North fifty five degrees west Sixty Perches Course then with the Rent of the Lines to the first tree and it is further covenanted concluded and agreed by and between all the Parties to these Presents for themselves and their and every of their heirs by these Presents in manner following that is to say that the said John West shall and will before the End of May Term next coming permitt and suffer the said Benjamin Rumsey to sue forth and prosecute against him the said John West one writ of entry sur Disseisin inle post returnable before the Justices of the Provincial Court at Annapolis thereby demanding the said Tenements with the Appurtenances herein before mentioned by such name and names numbers of acres Quantities ^Qualities^ Terms and Descriptions in said writ to be contained and in such Manner and Form as by Counsell learned in the Law shall be advised unto and upon which said writ of Entry so to be prosecuted and sued forth the said John West shall appear Gratis and vouch to warranty the common vouchee who shall appear and imparl and afterwards make default and depart in contempt of the court so that judgment may be thereupon had and given for the said Benjamin Rumsey to recover the said Tenements with the appurtenances against the said |
