(215) Possession now being by virtue of a Bargain and Sale heretofore thereof made all the aforesaid Land Tenements and Premisses with the appurtenances and the Remainders Rents Issues and Profits thereof or incident thereto To have and to hold the said Lands Tenements and Premisses with the Appurtenances and every Part and Parcell thereof unto the said John Knight and his heirs forever to the Intent and Purpose that the said John Knight shall and may become perfect Tenant of the Freehold of the Lands Tenements and Premisses aforesaid and shall and may stand and be seised thereof until a good and perfect common Recovery with double vouchers over may be duly had suffered and executed of the Lands Tenements and Premisses aforesaid according to the usual Course of Common Recoveries for the Assurance of Lands and Tenements in such cases used and accustomed And thereupon it is covenanted concluded and agreed by and between all the said Parties to these Presents for themselves and their and every of their Heirs by these presents in manner following that is to say that the said John Knight Shall and will before the End of May provincial court next permitt and suffer the said Benjamin Rumsey to sue forth and prosecute against him the said John Knight one writ of Entry sur Disseisin in le post returnable before his Lordships Justices of the Provincial Court at Annapolis thereby demanding against the said John Knight the said Lands Tenements and Premisses with the Appurtenances by such name and names numbers of acres Quantities Qualities Terms and Descriptions in the said writ to be contained and in such Manner and form as by Counsell learned in the law Shall be advised unto and upon which said Writ of Entry so to be prosecuted and Sued forth the said John Knight Shall Appear Gratis and vouch to warranty the said Isaac Vanbebber which said Isaac Vanbebber shall appear either in person or by attorney lawfully authorized and enter into warranty and after his Entry into warranty shall vouch to warranty the common vouchee who Shall likewise appear and imparl and afterwards make Default and depart in Contempt of the Court so that Judgment may be thereupon had and given for the said Benjamin Rumsey to recover the said Lands Tenements and Premisses with the Appurtenances against the said John Knight and for the said John Knight to recover in value against the said Isaac Vanbebber and for the said Isaac Vanbebber to recover in value against the common vouchee to the End One perfect common Recovery with double voucher may be thereupon had and suffered and all and every other Thing and Things be done and perfected needfull and convenient for the having and Suffering the same Recovery according to the course of common Recoveries in such Cases used and the same Recovery is also to be executed by one writ of habere facias Seisin accordingly And it is hereby further covenanted concluded and agreed by and between all the said Parties to these presents for themselves and every of them their and every of their Heirs that the said Recovery so as aforesaid or in any other Manner to be had and suffered of the said Lands Tenements and Premisses with the Appurtenances Shall be and enure and Shall be deemed adjudged and taken to be and enure and is meant and intended and by all the Parties to these Presents is hereby |
