(185) hundred and one Perches to the Land called Marlys Groves thence with a right Line to the first Tree Containing one hundred and ninety Acres Together with all Edifices Buildings Gardens Orchards ways waters water courses Commodities Priviledges Improvements Emoluments Advantages and Appurtenances whatsoever to the aforesaid several Tracts or Parcels of Land belonging or appertaining And the Reversion and Reversions Remainder and Remainders Rents Issues and profits of them or any part or Parcel of either of them To have and to hold the said Several Tracts or Parcels of Land and all and singular the Premisses with their and each of their Rights Members and Appurtenances unto the said John Hall his heirs and assigns forever Provided always and it is hereby covenanted concluded declared and agreed by and between the said Parties to these Presents that if the said Henry Hall his heirs and Assigns do and shall well and truly pay or cause to be paid unto the said John Hall his Executors Administrators or Assigns the full and just Sum of Eight hundred and sixty pounds five shillings Sterling ^in manner and form following (that is to say) the sum of four hundred and thirty pounds sterling^ on the Day of October which shall be in the Year of our Lord one thousand seven hundred and sixty eight and the further Sum of four hundred and thirty pounds five Shillings Sterling on the first Day of October which shall be in the year of our Lord one thousand Seven hundred and sixty nine with Lawfull Interest that then and from thence forth these Presents and every thing therein contained shall cease and be void any thing herein contained to the contrary thereof in any wise notwithstanding but if the said Several Sums of Sterling Money last aforesaid with lawfull Interest Shall not be paid on the respective Days and times above mentioned that then and from thenceforth it shall and may be lawfull to and for the said John Hall his Executors Administrators and Assigns on Failure of payment of either of the above Sums after three months notice in writing left at the Dwelling house of the Henry Hall absolutely to sell and convey away all and singular the said Tracts or Parcels of Land and Premisses and every part and parcell thereof and the surplus if any after the payment of the said Principal Sums of Eight hundred and sixty pounds and five Shillings Sterling and Interest to be paid to the said Henry Hall And the said Henry Hall for himself his heirs Executors and Administrators doth hereby Covenant grant and agree to and with the said John Hall his Executors Administrators and Assigns that any Purchaser or Purchasers of the said Premisses or any part thereof from or under him the said John Hall as aforesaid shall hold occupy possess and Enjoy the same free from any Interruption of him the said Henry Hall his heirs or assigns and clear from all Incumbrances or Claim of him the said Henry Hall his heirs or Assigns on account of any Equity of Redemption |
