(167) to exceed one perch square the said Richard Henderson his heirs and Assigns keeping at all times good Sufficient Bridges over the said Ditches by the side of the Dam and Race so that the Road to the Mill between the lines aforesaid and the Dam and Race aforesaid shall never by obstructed by the said Ditches But if the said Richard Henderson his heirs or assigns should upon Notice Given him or them fail in keeping up such Bridges as aforesaid for four Days after such Notice or should deprive the Mill aforesaid of any water except what may be drank as aforesaid at any Time whatsoever or should take the water farther into the Land hereby conveyed than aforesaid or let the Ponds aforesaid be larger than the size aforesaid for the space of eight Days after such Notice then in either of these cases the liberty hereby Granted to the said Richard Henderson his heirs and assigns of taking water for creatures as aforesaid shall totally Cease and Determine as if the same had never been Granted To have and to hold the said part of the Tract of Land aforesaid with the Appurtenances and access to water as aforesaid to the said Richard Henderson his heirs and Assigns To the only proper use and Behoof of him the said Richard Henderson his heirs and Assigns And to and for no other use Intent and purpose whatsoever And the said Walter Evans for himself and his heirs doth Covenant and Agree to and with the said Richard Henderson his heirs and assigns that he the said Richard Henderson his heirs and assigns shall and may at all times hereafter quietly and peaceably Hold Occupy and Possess the said part of the Tract of Land aforesaid with the Appurtenances and access to water as aforesaid Free and Clear of and from every Incumbrance and charge whatsoever And the said Walter Evans for himself his heirs Executors and Administrators doth further Covenant and Agree to and with the said Richard Henderson his heirs and assigns That he the said Walter Evans his heirs Executors and Administrators the said part of the Tract of Land aforesaid with the appurtenances and access to water as aforesaid unto the said Richard Henderson his heirs and assigns against all and every person and persons whatsoever shall and will for Ever hereafter well and Truly Warrant and Defend And the said Walter Evans doth further Covenant and Agree in manner aforesaid with and to the said Richard Henderson his heirs and Assigns That he the said Walter Evans his heirs Executors and Administrators shall and will at all times hereafter at the reasonable request and at at the proper Costs and Charges in the Law of him the said Richard Henderson his heirs and assigns Make do Suffer and Execute and cause to be made done (Suffered) |
