(377) all and singular the Premisses with their and each of their rights Members and appurtenances to him the said Joseph Ensor his heirs and assigns To the intent and purpose that the said Joseph Ensor may be and become perfect Tenant of the Freehold and Inheritance of the said premisses that a common recovery may be had and suffered against him in such Manner as is herein after mentioned and for that purpose it is hereby Covenanted Granted and agreed by & between all the said parties to these presents that before the End of the next April Provincial Court one or more Writ or Writs of Entry sur Disseisin en le post at the cost and charges of him the said Edward Day shall and may be brought and prosecuted against him the said Joseph Ensor in the Name of him the said John Rogers as Plaintiff or Demandant therein of and for the aforesaid Tracts of Land and Premisses with the appurtenances by such Name or Names Quantity Quality Number of Contents of acres or other certainties and discriptions as shall be apt and convenient in that Behalf to which Writ or Writs the said Joseph Ensor shall appear gratis in his proper person or by his attorney or attorneys lawfully authorized and shall Vouch to warrant the Premisses the said Edward Day who shall likewise appear gratis in his proper person or by his attorney or attornies lawfully authorised and shall and will enter into the said Warranty and Vouch over to Warrant the same premisses the Common Vouchee who shall likewise thereupon appear and enter into the said Warranty and after Imparlance make Default and such further and other proceedings shall be |
