       his act in writeing executed in his lifetime or by his last
       will and testament in writeing shall Nominate declare &
       appoint and in case of the said Marys death before the
       said Philemon Hemsley then this deed with all the
       Clauses and Covenants therein to be utterly void cease
       and determine and the said Philemon Hemsley doth for
       and in the Name of Possession of all and singular the s.d
       estate now give and deliver unto them the said W.m &
       John a Grey Nagg And the said W.m Newman and Jn.o
       Warren do hereby covenant promise and grant and
       agree for themselves their heirs ex.rs and adm.rs to &
       with the said Philemon Hemsley his ex.rs and adm.rs
       that the said Philemon Hemsley shall dureing the
       Joynt lives of him the said Philemon Hemsley and
       John ^Mary^ Contee have hold possess enjoy and keep in his
       own custody and possession all the said estate and
       every parcel thereof And that it shall be lawful for
       him covent convert to such improvements and increase
       thereof as he shall make to such use or uses as he in
       his discretion shall think fitt for the better Lively hood
       and Maintenance of them the said Philemon Hemsley
       and Mary Contee dureing their joynt lives as afd
       And the said Philemon Hemsley W.m Newman and
       John Warren partys to these presents doe declare and
       it is the true intent and meaning hereof that no
       clause covenant article or grant herein contained
