52 shall at any time hereafter be construed deemed or taken to debarr her the said Mary Contee of the third of the said Philemon Hemsleys Estate according to the act of assembly of y.e laws of Great Brittaine in case she shall think fit to betake herself thereunto and relinquish totally the settlements and security hereby made but that it shall be and remain in the power election and choyce of the said Mary Contee to be take he self to such third part if she shall soe fit think fit and relinquish the security and settlem.t hereby made for her & in case of her election to betake herself to such third part then this deed to be voyd to all intents and purposes otherwise to stand in full force and vertue In Wittness whereof the parties above menconed have interchangeably set their hands and seales the day and year above written signed sealed and delivered Phile Hemsley (sea) by the s.d Philemon Hemsley in presence of Jo Fraser Judith Warren On the back of w.ch aforegoing instrum.t was thus endorst Viz.t Maryland y.e 6 Nov.r 1719 Then Came the Reverand M.r John Fraser and M.rs |
