90 aforesaid to the said John Hodges or his attorney or agent in Maryland at or upon the five and Twentyeth day of May which shall be in the year of our Lord God one thousand seven hundred and fourteen and Bills of Exchange in Manner afd for the sume of one hundred pounds residue thereof to be drawn and Delivered to the said John Hodges or his attorney or agent in Maryland at or upon the five and Twentyeth day of May which shall be in the Year of our Lord God one thousand seven hundred and fifteen and that all and every of such Bills of Exchange when drawn shall according to the Custome of Merchants be well and truly honered & paid that then this Present Indenture and Every article Clause and thing herein Contained to Cease determine and be utterly Void (But on non payment of any of the said yearly sums or bills of Exch.a to Remain and be absolute to all Intents and purposes) any anything in these presents Contained to the Contrary thereof in any wise not withstanding And the said W.m Holland doth by these presents for himself his heires executors and administrators and for every of them Covenant promise and grant to and with the said John Hodges his executors and adm.rs in Manner and forme following (that is to say) that he the said W.m Holland his heires ex.rs or administrators shall and will well and truly pay or Cause to be paid unto the said John Hodges his executors adm.rs or assignes the said sum of five hundred pounds sterling mony of Great Brittain by good and sufficient Bills of Excha in such Manner and form and at the severall days and times herein before appointed for paym.t thereof without any Defalcation whatsoever And also that he the said W.m Holland hath not done Committed or Suffered any act matter or thing whatsoever whereby or wherewith he hath Charges Impeaches or Incumbered the said Lands and Premises in title Charge Estate or otherwise howsoever And that it shall and may be Lawfull to and for the said John Hodges his executors adm.rs and assignes (from and after default of Payment of all any or either of the said Yearly payments) Quietly and Peaceably to have hold and enjoy the said Lands and premises with the appurtenances (except before excepted) without the Lawfull Let or Mollestation of him the said W.m Holland his heires ex.rs or adm.rs or any other person or persons Lawfully Claiming or to Claim in by from or under him And Further that he the said W.m Holland and his heires shall and will at any time hereafter (after default of Payment of the said sum of five hundred pounds at the request Costs and Charges in the Law of the said John Hodges his executors adm.rs or assignes make doe acknowledge Levy Execute and Suffer or Cause to be made done acknowledged Levyed Executed and Suffered all and every such further and other Lawfull and reasonable act and acts thing and things devices Conveyances & assureances in the Law whatsoever for the further assureing surety sure makeing setling and Conveying the said Lands and premises (except before excepted) unto and upon the said John Hodges his executors adm.rs and (assignes) |
