91) assignes for and dureing all the remainder of the said Term of two thousand Years which shall be then to Come and unexpired be the same by matter of Record or not of record as by the said John Hodges his executors adm.rs or assignes or his or their Councill Learned in the Law shall be reasonably advised devised or required And it is Coven.ted Concluded and agreed upon by and between the said Parties to these p.rsents that untill default shall be made of or in the said Yearly payments or some or one of them in manner and forme herein before Limmitted and appointed it shall and may be Lawfull to and for the said W.m Holland his heires and assignes Quietly and peaceably to have hold use occupy possess and enjoy the said Lands and premises and every part thereof And that from and after the decease of the said Mary the Relict of the said Seth Biggs the third part of the said Land Called Biggs Purchase whereof the said W.m Lock is now possessed in right of the said Mary's Dowery shall be and remain lyable and Chargable with the payment of the said sume of five hundred pounds sterling in as full and ample manner to all Intents and purposes as if no exception or reservation thereof had been Made in this present deed anything in these presents Contained to the Contrary thereof in any wise notwithstanding In Wittness whereof the said W.m Holland to Two parts of this present Indenture and the said John Hodges to one part thereof Interchangably their hands and seales have sett the day and year first above written Will.m Holland (Sealed) On the back of the s.d deed was thus endorst Viz.t Sealed and delivered in the presence of us Rich.d Dallam William Holland Jun.r Nathan Rigby Mem.d that the eleventh day of February Annoq.r Dom 1711 Came before me Robert Bradley Esq.r one of her Majestys Justices of the prov.ll Court the w.thin named W.m Holland and acknowledged the within written Indenture to be his act and deed and the Lands and Tenements therein bargained and sold to be the right of the within named John Hodges his executors adm.rs and assignes according to the Tennour true Intent & meaning of the within deed Cap.t & Cognoirt die & Anno sup.rdas sidm fornam recorded Feb.ry y.e 28.th siat in eo Casu editi & provisi 1711 Coram me R Bradly 200 tob.o Cost |
