43) x.d This Indenture made this Eleventh day of June in the Year of the our Lord God seventeen hundred and Eleven Between Sarah Clagget of Calvert County widd.o of the one ^part^ and John Hyde of the Citty of the Citty of London Merchant and Charles Carroll of Ann arundell County in the province of Maryland Gent of the other part Wittnessth that the said Sarah Clagget for and in Consid.n of the sume of fifty five pounds three shill and nine pence ster to her in hand paid before the ensealing and delivery of these presents the receipt whereof she doth hereby acknowledge and thereof and of every part and parcell thereof doth fully Clearly and absolutely exonerate acquitt and discharge them the said John Hyde and Charles Carroll hath Given Granted bargained sold aliened enfeoffed and Confirmed and by these presents she doth Give Grant bargaine sell alien Enfeoffe & Confirme unto them the said John Hyde and Charles Carroll their and either of their heires a Certain peice or parcell of Land being three hund.d acres part ^of^ a Tract of seven hundred acres called Greenland lying in Prince Georges County next adjoyning to the Land of Co.ll Henry Darnall Called the Woodyard to have and to hold the said parcell of Land unto them the s.d John Hyde and Charles Carroll their and either of their heires & assignes ^for ever^ and the said Sarah Claget for herself and her heires doth Covenant promise Grant and agree to and w.th the said John Hyde and Charles Carroll that she the said Sarah shall and will from time to time and at all times hereafter warr.t and defend the said parcell of Land from all Manner of Incumbrances whatsoever unto them the said John Hyde and Charles Carroll their heires and assignes for ever Provided always and it is the true intent and meaning of these presents that if the said Sarah Clagett shall at any time before the Eleventh day of June which shall be in the Year of our Lord seventeen hundred and twelve pay or Cause to be paid unto the said John Hyde and Charles Carroll or either of them the one moyety of the abovesaid sume with Legall Interest for the same and the other part Moyety or half part of the said sume w.th Like Interest for y.e same at or before the eleventh day of June w.ch shall be in the year of our Lord seventeen hundred & thirteen that then this deed and all Clauses and Covenants therein Contained are to be Void & of noe Effect otherwise to stand in full force & Virtue In Wittness whereof the said Sarah has hereunto set her hand seale the day & year first above written sealed and delivered in presence Sarah Clagett (sealed) of John Michcell Jacob on the back of the s.d Deed was thus endorst Viz.t June 11.th 1711 Then Came the within named Sarah Claggett before me Philemon Lloyd Esq.r one of her Majtys Justices of the prov.ll Court and (acknowledged) |
