40 At the head of a valley being a bounded tree of a Tract of Land Laid out for the hon.ble Benet Low Esq.r Called Timber Ridge and runing from the said White Oake for Length west three hundred and twenty per.s and from the end of the west Line by a Line drawne north one hundred and fifty per.s and from the end of the North Line by a Line Drawn east three hundred and Twenty per.s from the end of the East Line by a Line drawn south two hundred and fifty per.s to the first marked white oake Cont.a and Laid out for five hundred acres more or Less and the revercon & Revercons remaind.r and Remainders rents Issues and proffitts thereof and also all Deeds patt.ts Evidences and wrightings that Concerne the same or any part thereof To have and to hold the said Lands and all and singuler other the premises hereby Granted bargained and sold and every part and parcell thereof To have and to hold the said Land and all and singuler other the premises hereby Granted bargained and sold and every part and parcell thereof w.th the appurtenances unto the said John Hyde his heires and assignes for ever Provided always and upon Condicon that if the said Cacilius Butler and Marg.t his wife or either of them their or either of their heires ex.rs adm.rs or assignes shall well and truly pay or Cause to be paid unto the said Jn.o Hyde his ex.rs or assignes the said sum that then and from thenceforth this present Ind.r and the Grant hereby made shall Cease determine and be utterly Void any thing herein Contained to the Contrary in any wife notwithstanding And the said Cæcilius Butler & Marg.t his Wife or either of or themselves and either of them their and either of their heires ex.rs adm.rs and assignes do joyntly and severally Coven.t pmise & grant to and with the said John Hyde his heires and assignes by these presents in Manner and forme following (that is to say) that they the s.d Cecelius Butler and Marg.t his wife on the Day of the date hereof & at the time of their sealing and Delivery of these presents are & stand Lawfully and Rightly seized of a Good sure perfect absolute and indefeazable Estate of Inheritance in fee simple to them and their heires for ever of and in the said Lands and hereby granted premises and now have in themselves full pow.r to grant the same unto the said John Hyde his heires and assignes in Manner ^as^ afd and that he the said John Hyde his heires or assignes (subject to the provisoe afd) shall or may Lawfully peaceably & quietly have hold and enjoy the said Lands and p.rmises hereby granted w.th the appurtenances without the Let Eviccon Claim or Demand of them the said Cæcelius Butler and Marg.t his wife or either of them their or either of their heires ex.rs adm.rs or assignes or of any other person or persons w.tsoever and that free and Clear and freely and Clearly acquited exonerated and Discharged of and from all form.r & other Gifts Grants and Leases Morgages Dowers thirds and of and from all other Estates titles Charges and Incumbrances (w.tsoever) |
