39 Mem.d On the back of a Certain Deed Between Nich.o Sporne x.d of the one part and Charles Carroll Tho.s Greenfield and Joshua Cæcill of Vide Greenfield the other part Recorded in Lob T L N.o 2 fol 627 was thus Endorst Viz.t & Cecill Whereas the time Limitted for the payment of the money within menconed acknowledgm.t is some Time ^since^ elapsed and Consequently the Land within Menconed forfeited to Carroll in to y.e within named Grantees I Do hereby further for a Confirmation fol 5 205 to them and their heires absolutely acquitt exonerate and Discharge as well them as the Land p.rmises within specified of and from all manner of Right or Redemtion w.ch for my heires or assignes may or Can hereafter Claime thereunto fully Granting and Confirming the same unto the within Parkes and their heires according to y.e Estate made by the within deed to them in Common As Wittness my hand and seale this 13.th Day of Aprill Annoq Dom 1711 Wittness Present John Michcell Nich.o Spence (sea) Jacob recorded May y.e 28.th 1711 x.d This Indenture made the sixteenth day of May in the year of our Lord 1711 Between Cecelius Butler of S.t Maries County in the province Gent and Marg.t his wife of the one part and John Hyde of London Merch.t of the other part Whereas the said Cæcilius Butler haveing had occasion to borrow and take up of y.e s.d Jn.o Hyde a Certaine sum of money for the secureing the repaym.t thereof the said Cæcilius Butler did assigne and set over Certain Land & Negroes subject to a pvisoe to be Void on paym.t of the s.d sum as Relacon being thereunto may more fully appear Now this Indenture Wittnesseth that the said Lands and negroes not being a suff.t sec.ry for the said sum) for the further securing the repaym.t thereof and also for and in Consid.n of the sum of five shill to them the said Cecelius Butler and Mary his wife or one of them in hand paid the receipt whereof they do hereby acknowledge and thereof & of every part and pcell thereof doth Discharge the said John Hyde they the said Cecelius Butler and Marg.t his wife have Granted Bargained & sold and by these presents Doe and Either of them Doth Grant bargaine and sell unto the said John Hyde his heires and assiss All that tract or parcell of Land Called Roystons purchase lying and being in Cæcill County in the woods and upon a branch of a Creek Called Sassafrax Creek begining at a marked white oake (at the head) |
