34 all Moneys therein Menconed and Thereupon to Grow due and payable and for and in Consid.n of five shillings to the said Thomas Alcock in hand at or before Ensealing and Delivery hereof by the said Joseph Usher well and truly paid the receipt whereof he doth hereby acknowledge he the said Thomas Alcock hath Granted bargained sold & demised and by these presents doth grant bargaine sell and Demise unto the said Joseph Usher his ex.rs adm.rs and assignes all that the afd Tract ^or parcell^ of Land Called Straw Bridge lying in Talbott County afd in and by the said Recited Grant menconed or Intended to be granted and the rents issues and profitts thereof and all other Rights Benefitts and previledges thereunto belonging togeather w.th the said Recited Grant and all deeds and wrightings Concerning the premises To have and to hold the said tract or parcell of Land and all other the premises by the said writed Grant Conveyed and herein ^before^ Menconed or Intended to be Granted sold and Demised unto the said Joseph Usher his heirs ex.rs ad.rs & assignes from the day next before the Date of these presents for and dureing and so in y orig.ll unto the full end and Terme of five hundred yeares from thence next ensueing and fully to be Compleated and Ended without Impeachm.t of or for any Manner of Wast Yielding and Paying therefore unto the said Thomas Alcock his heires or assignes the rent of one peper Corne only on the feast day of the annunci.a of the blesed Virgin Mary in Every Yeare (of the same be Lawfully demanded) provided always and these presents are up on this Condicon never the less that if the said Thomas Alcock his heires ex.rs ad.rs or assignes do and shall well and truly pay or Cause to be paid unto the said James Bosley or to the said Joseph Usher or either of them their or either of their ex.rs adm.rs or assignes the said sum of fifty pounds on the day & time Limitted in the Condicon of the said Recited obligation and do then and thereby well and sufficiently save and Keep harmless and Indemnified the said Joseph Usher his heires ex.rs ad.rs and assignes and his and their Lands Tenements Goods and Chattells of and from the said recited bond and obligation and Moneys therein Menconed & Thereupon to Grow due and all actions suites costs Charges payments & Damages by reason thereof then these presents and the Grant & Demise hereby made and every thing herein Contained shall Cease Determine and be utterly void and of none Effect any thing afd to the Contr.a Notwithstanding and the said Thomas Alcock for himself his heires ex.rs ad.rs and assignes doth hereby Covenant promise and agree to and w.th the said Joseph Usher his ex.rs admin and assignes as foll (that is to say) That he the said Thomas Alcock his heires ex.rs or ad.rs shall and will pay or Cause to be paid the said sum of fifty p.ds according to the Limit.a and true meaning of the afd provisoe and of these presents and save and Keep harmless and indemnifie the said Joseph Usher his heires ex.rs ad.rs and assignes and his & their Lands tenements goods and Chattells from the said Bond (and) |
