29 His heirs Executors and Administrators and every of them by these presents in maner all the aforesaid sixty five Accers of land and premisses with their and every of their appurtenance before by these presents given and granted to the said Charles Carroll his heirs and Assignes from and against him the said Thomas Hardesty his heirs Execu.rs and Admi.rs and from and against all and every other person or persons Whatsoever (except before excepted) shall and will warrant and for ever hereafter by these presents defend And allso that he the said Thomas Hardesty hath in himself Good Right full power and Lawfull authority to Give grant bargaine sell alien enfeoffe and confirme the afd sixty five acres of Land and premises w.th every of their appurtences and every part and pcell thereof (except before excepted) unto him the said Charles Carroll his heires and assignes for ever as afd and that he the said Charles Carroll his heires Ex.rs adm.rs and assignes shall and may peaceably & Quitely from henceforth and for ever hereafter have hold use occupy posses and enjoy all the afd sixty five acres of Land and premises w.th Their and every of their appurtenances and every part and pcell Thereof (except before excepted) with out any Let set suit trouble Disturbance molestation interruption or hindrance of him the said Thomas Hardesty his heires ex.rs or adm.rs or any other person or persons whatsoever And that the said sixty five acres of Land and premises w.th their and every of their appurtenances and every part and parcell thereof shall be remaine and continue free and clear or otherways well and truly saved harmless and Kept Indemnified (except before excepted) of and from all manner of former and other Gifts grants bargaines sales Leases Dowers Joyntures Mortgages rents arrearages of Rents Judgm.ts Extents Executions and all other Incumbrances whatsoever had made suffered done or ascented into by the sd Thomas Hardesty or any other person or persons whatsoever (except before excepted) and also the Rents & services hereafter Growing due & payable to the Chief Lord ^or Lords^ of the Fee or fees only & alone excepted and foreprized And Further the said Thomas Hardesty his heirs ex.rs & ad.rs shall and will at all times for ever hereafter at the Reasonable request and at the proper Cost and Charges in the Law of him the said Charles Carroll his heires ex.rs adm.rs or assignes make do acknowledge execute so in orig.ll and suffer or cause to be to be made done acknowledged executed & suffered all and every such further and other reasonable act & acts thing and things device and devices assurance and other convey.a requisite and necessary in the Law for the future better and more perfect assureance sure makeing and conveying the afd sixty five acres of Land and premises w.th their and every of theire appurtenances and every part and parcell thereof (except before excepted) to him the said Charles Carroll his heires and assignes for ever be it by fine or fines deed or deed indented and inrowles the inrowlment of this present Feoffm.t Release or Confirmation (or) |
