28) and adm.rs and every of them by these presents hath Given Granted bargained sold aliened enfeoffed and confirmed and by these presents doth for himself and his heires fully Freely and absolutely give Grant bargaine sell alien enfeoffe and confirme unto the afd Charles Carroll his heires and assignes for ever And that the afd sixty five acres of Land being part of the afd tract or parcell of Land Called Hardestyes Choice Lying in Calv.t County on the east side of Puttexent River and Beginning at y.e north west bounded Red Oake of the said Land and Runing downe the River these following courses and distances Viz.t south Twenty degrees west Twenty four per then south thirty four Degrees westerly one hundred & eight per then south twenty one Degrees westerly thirteen per to another oake standing by the River side being the divisionall bounded Tree between the said Hardesty and the said Bartley then up the said Divisionall Line north seventy six deg.rs easterly one hundred and seventy per to an oake bounded w.th notches then north thirty two Deg.rs westerly one hund.d and five acres more or Less Togeather w.th all houses out edifices and buildings Yard Gardens Orchards Ways passages waters and water Courses timber and timber trees woods & underwoods and appurtenances watsoever to the said sixty five acres of Land belonging or appertaining w.th the Reversion and Reversions Remainder & Remainders rents issues and proffitts whatsoever and all Deeds wrightings escripts and minuments touching or any ways concerning the afd sixty five acres of Land and premisses w.th their and every of their apputts and every part and pcell thereof except thereafter by these presents excepted (that is to say) excepting and allways Reserveing out of the afd sixty five acres of Land and premises all those the severall Lot or Lots already taken up an possessed by any other person or persons whatsoever by Virtue of a Late act of Assembly erecting that part of the afd tract of Land Called Hardestys Choice into a towne or port w.th free ingress egress and regress into out of and from the same for the said sever.ll person or persons or their assignes owners and possessors of the s.d severall and Respective Lott or Lotts or any other person or psons whatsoever at times Conv.t To have and to hold the afd sixty five acres of Land and p.rmises With their and every of their Appurtenances and every part and percell thereof except before in theire presents excepted to the said Charles Carrol his heirs and assignes and to the only proper use and behoofe of the said Charles Carol his heirs and assignes for ever and to and for none other use intent and purpose whatsoever And the said Thomas Hardesty for himself his heirs execu.rs and admin.rs and assigns and to and with every of the by these presents in Maner and form following (that is to say) that and for every of them doth hereby covenant promise grant and agree to and with the said Charles Carroll his heirs executor admin.rs and assignes and to and with every of them by these presents in maner and form following that is to say That he the said Thomas Hardesty (his) |
