22 x.d This Indenture made this second day of Nov.r in the 9.th year of the Reigne of our Sovereigne Lady Anne by the Grace of God of Great Brittaine France and Ireland Queen defender of the faith &c Annoq Dom 1710 Between Edward Parish of Ann Arund.ll County in the province of Maryland planter on the one part & Henry Ward of Cæcill County in the same pvince Gent on the other part Wittnesseth that the said Edward Parrish for and in Consideracon of the sume of ten thousand pounds of tob.o to him in hand paid by y.e s.d Henry Ward the Receipt whereof he the said Edward doth hereby acknowledge & thereof & of every part and parcell thereof doth acquitt exonerate & discharge the s.d Henry his heires ex.rs and adm.rs for ever by these presents hath granted bargained sold aliened and confirmed and by these psents doth grant bargaine sell alien and confirme unto the said Henry Ward All that tract or pcell of Land Called Haye Downe lying in a River on the east side of Chesepeake bay called Elk River formerly in Baltemore now Cecill County and on the south side of the s.d River in a Creeke Called Cap.t Johns Creeke on the south side of the said Creeke Begining at a marked Spannish Oake standing on a huccleberry point by a branch Called Gouldsmiths branch Runing from the s.d oake for bredth down the Creeke ninety perches to a marked oake standing on a branch called Downes branch being the first branch of the maine Creeke easterly of one Caukers Land soe formerly called and afterwards belonging to one James White bounded on the said oake by a Line drawne south southwest for Length five hundred thirty & four perches bounded on the south south west by a Line drawn east south east ninety perches bounded on the east south east by a Line drawn north north east five hundred thirty & four perches unto the first marked oake by Gouldsmiths branch w.ch said Land was formerly Laid out for one Henry Downes of the County of Baltemore planter Containing three hund.d acres more or Less To have and to hold the said pcell of Land Togeather with all and singuler houses out houses edifices orchards gardens Woods and underwoods trees and timber Trees on the same Land standing being and Growing and also all & singular other Rights members previledges to the same belonging or appertaining unto the said Henry Ward his heires and assignes to the only proper use and behoofe of him the s.d Henry Ward his heires & assignes for ever And that free and clear and freely and clearly acquitted exonerated and discharged of and from all & all manner of former or other Bargaines Sales Leases Mortgages Extents Dowers or title of Dower and of and from all other Incumbrances whatsoever had made comitted or suffered to be had made or comitted by the s.d Edw.d Parrish or any other pson by y.e means consent privity or procurem.t of him the said Edward the Rents & services from henceforth growing due and payable to y.e Chief Lord or Lords of the fee only excepted and foreprized And the s.d Edward Parrish |
