21) defend the same against all other psons whatsoever to him the said Charles Carroll his heires and assignes for Ever subject nevertheless to this provisoe and condicon that if the s.d W.m Taylard or Audry his wife or either of their heires ex.rs or adm.rs shall & do well & truly pay or cause to be paid unto him the said Charles Carroll his exe.rs adm.rs or assignes the full & just sume of eighty pounds eleven shill of Lawfull money of England by bills of excha to be approved of and to be delivered at the dwelling house of him the s.d Charles Carroll in Annapolis afd as ^or before^ the Last day of July next togeather w.th Legall Interest for the same w.thout any fraud covin or any further delay that then & from thence forth this present Indenture of Bargaine and Sale shall cease detirmine and be utterly Void and of none effect to all intents constructions and purposes whatsoever anything herein before contained to y.e contrary thereof in any wise notwithstanding In Wittnese whereof the s.d parties to these presents have interchangeably hereunto set their hands and seales the day & yeare first above Written Sealed and delivered in the W Taylard (S) psence of Benja Rawleigh Rich.d Rudyard Audry Taylard (S) On the back of the afd deed was thus endorsed Aug.t y.e 7.th 1710 Then Came W.m Taylard and Audry his wife before me Philemon Lloyd Esq.r one of her Majtys Justices of the prov.ll Co.rt and the s.d Audry being privately examined gave her free consent and both acknowledged y.e same to be the right of the w.thin Menconed Charles Carroll to hold the same to him his heires & assignes for ever according to act of Assembly in that Case made & provided Taken & acknowledged the day & yeare aboves.d recorded Nov.r 25.th 1710 before me Phile Lloyd 1210 |
