214) of & in the said goods Chattles ^and^ Implements of houshold stuff of a Title no ways to be made Void by any matter Cause or thing whatsoever by him or her done heretofore and that they will at any time hereafter doe Suffer or Cause to be done any matter Cause or thing whatsoever for the further and better assureing of the afore mentioned premises both Real and personall as by the Said Jacob Henderson or his Council shall be advised or required according to the true Intent and meaning of these presents Provided always and it is Covenanted Concluded Conditioned & agreed upon by and between the said parties to these presents That if they the Said Richard Duckett & Charity his wife their heirs & Assignes or any of them doe and shall yearly & every year ship in some Ship bound for London & to some Merchant there one good ^and^ weighty hh.d of tob.co on their own ^proper^ Acc.t & Risque the produe whereof is to be Carried to the proper account of the Said Jacob Henderson his heirs and Assignes the said shipping to begin by the first of March next Ensueing the date hereof & soe continue yearly & every ^year^ untill y.t y.e produce of such Tobaccos Sent shall Discharge and pay the said Debt of one hundred and eleven pounds as above said without there being Charged Interest for the Same unto the Said Jacob Henderson his heirs or Assignes or that they otherwise Comply with the Same Then This present Bargaine and Sale and Every Clause Article Matter and thing herein Contained shall to all Intents and purposes and Constructions be utterly Void and of none Effecct any thing herein ^before express or^ contained to the Contrary Notwithstanding In Wittness whereof the said Richard Duckett and Charity his wife have hereunt Sett their hands and seales the Day and year above Written Richard Duckett (Seale) Charity Duckitt (Seale) Signed Sealed and Deliverd in the presents of us her her Mary Wilson Jane X Champain Marg.t Eliza J Snay mark mark On The back of the aforegoing Deed was Thus Endorst Viz.t Mem.d that the within Written Indent.r was this first day of May (1714) |
