194) to the same bargained premises and every of them belonging or in any wise appertaining To have and to hold the said severall tracts of land negroes and premises unto him the said Charles Carroll his heirs and Assignes for ever to and for the only proper use and behoof of him the said Charles Carroll his heirs and assignes for ever and to no Other use Intent meaning purpose or Construction whatsoever And the said Joshua Cecill doth hereby for him and his heirs Covenant promise grant and agree to and with him the said Charles Carroll his heirs and assignes that the said four severall tracts or parcells of land and negroes and their and every of their appurtenances at the time of the ensealing and delivery of these presents are Clear and free of and from all and all manner of Incumbrances Charges or Intanglements whatsoever save only the Quit rents that hereafter shall grow due to the Lord proprietary and that the same and every part thereof ag.t all persons whatsoever he will now and at all times hereafter warr.t and defend unto him the said Charles Carroll Esq.r And the said Joshua Cæcill doth hereby further for him and his heirs Covenant promise grant and agree to and w.th him the s.d Charles Carroll Esq.r his heirs and assignes that if any one any or either of the negro slaves afd shall happen to dye sicken be maimed or do Otherwise then well that then and in such case the said Joshua Cecill his heirs and Assignes shall be Obligd to make good such or so many of them as shall happen to faile by such ^or^ Like number of other slaves of the ages strength & ability or the sume of thirty pounds sterling for every one dying sickening or that shall do Otherwise then well as afd Provided always and it is the true Intent and meaning of these presents that if the said Joshua Cecill his heirs or Assignes shall or will (by the produce of four Tonn of tobacco to be by him them or any of them Executors administrators or Assignes shipt or freighted to some Merchant in great Brittaine yearly and every year for and dureing the term of three years next ensueing) pay or Cause to be paid unto the above named Charles Carroll his ex.rs adm.rs or |
