15 x.d This Indenture made the Twenty second day of August in the Ninth Yeare of the Reigne of our Sovereigne Lady Anne by the Grace of God of Great Brittaine France and Ireland Queen defender of the faith &c Annoq Dom one thousand seven hundred and ten Between Renatus Smith of Queen Anns County Gentl one of the Ex.rs of Robert Smith Esq of ye afd County deced and Anthony Ivy of the afd County Gentl the other of the Ex.rs and Husband of Anne Daughter & heires at Law of the said Robert Smith of the one part & John Gresham Jun.r of Anne Arundell County of y.e other part Witnesseth that whereas the Right honble Cæcilius of Noble Memory late Lord and Propriort.r of the province of Maryland Avalon Lord Barron of Baltemore &c by his Letters patt.ts bearing date the 25.th day of August 1666 did grant unto Henry Harman and Mathew Mason all that tract or pcell of Land Called Batchellors Resolution lying and being in Kent County on the north side of Chester River & on the west side of a Creeke Called Morgans Creeke Cont.a & formerly Laid out for one thousand acres More or Less &c who by their deed Indented bearing Date the 4.th day of August Anno Dom 1694 Did bargaine &c the same unto the afd Rob.t Smith w.ch said Rob.t Smith did by his Last will & Testament in Wrighting Fully impower and authorize his said ex.rs to sell & dispose of severall tracts and pcells of Land in this province to him belonging to the uses in his said will mencond & amongst y.e rest of the above menconed Land Now this Indenture Witnesseth that they the said Renatus Smith & Anthony Ivy (by virtue of the said will of the said Robert Smith) for & in consideration of the sume of ten thousand four hundred & sixty eight pounds of tobacco & the sume of sixty five pounds sterl & Currant Money to them in hand paid by the afd John Gresham Jun.r at & before the ensealing and Delivery of these ^psents^ the receipt whereof they do hereby acknowledge & every part & pcell thereof do clearly & absolutely acquitt Exonerate and Discharge the said John Gresham his heires ex.rs & adm.rs and therewith acknowledge themselves to be fully satisfied contented & paid Have given granted alienated bargained sold enfeoffed & confirmed and by these psents doe joyntly and severally grant alein bargaine enfeoff & confirme unto the said John Gresham his heires & assignes for ever All that pcell or tract of Land called the uppermost part of the above menconed tract of land Called Batchellors Resolution lying in Kent County upon a Creeke on Chester River called Morgans Creeke Begining where Edward Bathursts Land ends on Morgans Creeke by a branch called Batemans Branch & runing up and with the said Creeke north east for breadth two hundred thirty two perches then by a Line Drawne North west for ^length^ breadth four hundred perches then by a Line drawne south west untill it Intersect & meet with Edward Bathursts Lines then with the said Bathurst Lines Downe ye branch to the first begining on the s.d Creek Containing & Laid out for five hundred acres more or Less To be held of the Manner of Kent County togeather w.th all & singuler its woods Houses Edifices buildings and orchards w.th all other appurtenances whatsoever thereunto belonging or in any wise appertaining & also all the Estate Right title Interest property or poss.n claime and demand whatsoever of them ye said Renatus Smith & Anthony Ivy their heires ex.rs or adm.rs in or to y.e (same) |
