127 promise grant and agree to and w.th him the said Charles Carroll & his heires that the Land and Premises herein before bargained and sold are the Time of the ensealing and delivery hereof Clear and free of and from all and all manner of Incumbrances whatsoever whether by former bargaines sales or statutes Judgments forfeitures Recognizances or attainders of him the said John Jones or by any other wayes or meanes Whatsoever save only the Quitt Rents hereafter to grow due to the Right hon.ble the Lord propry And the said John Jones doth by these presents further Covenant promise grant and agree to and w.th him the said Charles Carroll and his heires that the said Two percells of Land and premises he will now and at all times hereafter warr.t & defend unto him the said Charles Carroll his heires & assignes for Ever ag.t all & all manner of persons whatsoever Provided allways and it is the True Intent & MEaning of these presents that if he the said John shall pay or Cause to be paid unto the said Charles Carroll his Ex.rs ad.rs or assignes the Just and full sume of Eighty one pounds four shil sterl being the Consideracon money above specified or the sume of one hundred and Eight pounds five shil & four pence Currant money of Maryland in and by such payments as are herein after expressed (Viz.t) one third part thereof w.th Legall Interest for the whole sume or Consideracon money att or upon the Tenth day of Octob.r next as also att or upon the Tenth day of Octob.r then next foll.o another third part of the said Consid.n mony w.th Legal Interest for the two thirds then due And Lastly att or upon the Tenth day of Octob.r w.ch shall happen to be in the yeare of our Lord one thousand seven hundred and Eleven the Rem.a third part then due w.th Legall Interest for the same that then this deed and all articles Clauses and Covenants therein Contained are to be Void and of noe Effect otherwise to remaine absolute & in full force & Vertue In Testimony whereof the said parties have hereunto Interchangably sett their hands & affixed their seales the day & yeare first above written Sealed & D.d in Psence John Jones (seal) of W.m Fitz Redmond August y.e 9.th 1709 Then Came the above named Jn.o Jones before Nicholas Jacob me Phile Lloyd Esq one of the Justices of her maj.ty prov.ll Court of this province & acknowledged y.e above to be his act & deed according to an act of Assembly provided in like Cases Phile Lloyd 694 |
