861 (834 Along the land now or late of John Judson one hundred and two Chaines thence north halfe a point west fifty six Chaines and thence along the land now or late of Joseph Croshaw to y.e place where it begunn east three quarters north seaventy five Chaines which said one hundred and fifty acres of land was late in the tennure and occupation of the s.d John Davis and of Thomas Davis and James Vaulx or some or one of them the other one hundred acres of land parte of the said two hundred and fifty accres was late in the tennur and occupation of John Thomas the s.d John Davis Thomas Davis and James Vaulx or some or one of them and abbutting and adjoyning to and upon the said one hundred and fifty acres w.th all messuages Lands Tenements Rents Services Houses outhouses Yards Back sides Easements Gardens orchards enclousers feilds Pastures Comons Meddowes Pastures feedings Marches Swamps woods Underwoods ways waters watercourses and all Proffitts Comidities and Advantages tot eh said two hundred and fifty acres of land and every parte and parcell thereof belonging or in any wise appertaining together with all libertyes prerogatives and royalties of hunting Hawking Fishing and Fowling and all other priviledges Prerogatives Royaltyes Rights Members and Appurtenances of the same and every parte thereof Excepted and always foreprised out of this present Grant and Release fifty acres of Land part of the said two hundred and fifty acres formerly Granted by the said Robert Vaulx to Arthur Lunn and his heires for ever To have and To hold the said Granted p.rmisses w.th the appurtenances and every parte and parcell thereof (Except before Excepted) unto the said Stephen Fauace and to his heires and assignes for ever to the only proper use and behoofe of him the said Stephen Fauace his heires and assignes for ever to be held of our Soveraigne Lord the King his heires and successors under the Quit rents due and accustomed to be paid for the same in free and coman soccage And the said Robert Vaulx and Elizabeth his wife doe for them selfeds and either of them their and either of their Heires Ex.rs and Adm.rs Covenant promise grant and agree to and with the said Stephen Fauace his heires Ex.rs and assignes In manner following (that is to say) that they the said Robert Vaulx and Elizabeth his wife theire heires Ex.rs and Adm.rs all and singular the herein before Granted p.rmisses w.th the appurtenances unto the said Stephen Fauace and to his heires and assignes for ever against them the said Robert Vaulx and Elizabeth his wife of a good sure pfect and Indefeasable Estate in Fee simple in all and singular the hereby Granted p.rmisses are Rightfully and lawfully seized without any manner of Revocation Inlade Escheat Condicon or Limitation to Alter or Defeat the Estate hereby made of the premisses afores.d or any parte thereof And that they the said Robert Vaulx and Elizabeth his wife are y.e true and lawfull owners of y.e same and now have in themselves full power and absolute authority to bargaine sell and convey the p.rmisses afores.d w.th y.e appurtenances to the said Stephen Fauace and to his heires and Assignes for ever And that the said Stephen Fauace his heires and assignes (under the Quitt rents due and accustomed to be paid for the same) shall and may for ever hereafter Peaceably and quietly have hold use possess occupie and Enjoy all and singular the afore mentioned p.rmisses with the appurtenances (Except before Excepted) and recieve and take to his and their owne proper Use the Rents Issues and proffitts thereof without any manner of lett suitt trouble or molestation whatsoever free and Cleare of and from all former Guifts Grants Bargaines Seales Mortgages Intailes Dowres Joynters Except the Rights of Dower in and the p.rmisses of Elishua the wife of John Franke of the said County of Dorchester Planter) Judgments Extents fines and all other Charges Titles Troubles and Incumbrances whatsoever And further that they the said Robert Vaulx and Elizabeth his wife and their heires And All psons Claiming by from or Under them or either of them shall and will any time within seaven yeares now Next coming at the reasonable request Costs and Charges in the Law of the said Stephen Fauace his heires or Assignes doe Accknowledge suffer and Execute all such further and other Act and Acts Devices Assureances or Conveyances in the Law for the better Assureing and sure makeing of all and singular y.e before bargained prmisses unto y.e said Stephen Fauace His heires for Ever to his and their own proper Use as by the said Stephen Fauace his heires or assignes or his or their Councill learned in the Law shall be reasonablely devised advised or required And lastly they the said Robert and Elizabeth his wife Doe by these p.rsents make ordain appoint and Constitute Phillip Ludwell jun.r and Benjamen Harrison of Virg.a Gentlemen theire and either of theire All [illegible] Joyntly or severally to appear either in The |
