837 (817 out Into one Intire Tract according to the antient meets and bounds begining at an old bounded Oake standing on the south side of the Eatern Creek and running East North East two hundred and fifty pearches and from the End of the said Line by a line Drawne South South East three hundred sixty five pearches then south west one hundred and Eighty pearches and from the End of the said south west Line by a Line Drawne of south west three hundred and ninty pearches with the Bay then by a line Drawn north and by East to the Eastern Creek and up the same five hundred and forty pearches to the first bounded oake containing one thousand twenty one acres To have and To Hold the said Two Tracts of Land as now surveyed and Laid out into one Intire Tract containing one thousand twenty one acres more or less with all houses buildings and appurtenances thereunto belonging or anywise appertaining to the s.d Abraham Johns and William Cole their heires and assignes to y.e only proper use and behoofe of them the said Abraham Johns and W.m Cole their heires and assignes for Ever & the s.d James Rigby for himselfe his heires Ex.rs Adm.rs doth further covenant and promise and Agree to and w.th the s.d Abraham Johns and William Cole their heires and assigns That the afores.d Tract of Land w.th the Appurtenances thereunto belonging shall quietly use hold occupy posses and Enjoy without any lett Trouble or molestation from him the s.d James Rigby or his heires or from aney maner of pson or psons whatsoever and will for Ever warrant and Defend the same from all former Gifts grants bargains sales Claim or Claimes of any pson or psons whatsoever the rent which shall become due to the Lord of the Fee only Excepted and foreprised and shall and will from time to time and att all times hereafter for and During the Space of seaven yeares att y.e Request of the said Abraham and William and at their proper Cost and Charge make such further assureance or assureances Conveyance or conveyances or by the said Abrahams and W.ms Councill learned in the Law shall be reasonablely Devised or required In Wittness whereof the s.d parties to these Indentures have Interchangeablely sett their hands and seales the Day and Year above written James Rigbie (sealed) Signed Sealed & Delivered in p.rsence of us Charles Carroll Phillip Clarke Porte of Annapolis May the twenty sixth one thousand six hundred ninety & seaven Then Came before James Rigbie and Elizabeth his wife before us Richard Hill and John Bollard Esq.r two of his Maj.ties Justices of the Provincill Court and did accknowledge the above Deed of Conveyance to be their Act and Deed for y.e Land Above and w.th in mentioned and the said Elizabeth being by as particularly prudally Examined did accknowledge that if her Free will without aney compulsion or threats of her said husband she did consent to the sale of the said Lands In testimony whereof we have hereunto sett our hands May y.e 26.th 1694 Richard Hill Then rec.d for y.e Alienacon of Eight hundred Acres of y.e Jn.o Pollard above menconed Land being old Rent the sume of sixteen shillings sterrl as wittness my hand Charles Carroll |
