827 (807) Memorandum That this 15.th day of September 1697 it is mutually agreed upon Between Charles Carroll and Gabriell Parratt that whereas one Steerman threatens to Eject y.e said Parratt out of parte of three manno.rs of Land which he bought latly of Phillip Lynes y.e s.d Charles in consideracon of y.e sume of twenty pounds sterl to be p.d him by y.e s.d Gabriell whereof he has rec.d foure shillings six pence in Earnest and the remaind.r to be paid in one months time after y.e Date hereof Doth hereby bind himselfe his heires Ex.rs and Admin.rs to Defend y.e s.d title against y.e said Steerman & his heires and that in case y.e said Steerman should Recover any parte of y.e said Land y.e said Charles is to make ^good^ a proportionable vallue as y.e same shall be appraised by two Indiffrent persons unto y.e said Gabriell and his heires In Wittness whereof both parties have hereunto sett their hands The Day and Yeare above written Charles Carroll Witness p.rsent Gabriell Parratt Jn.o Freeman Orlando Greenslade This Indenture made The third Day of July In the 9.th Yeare of y.e Reigne of our sovereigne Lord King William the Third and in y.e Yeare of our Lord God One Thousand six hundred ninty and seaven Between John Jacob of y.e County of Ann Arr.ll in y.e Province of Maryland & Anne his wife of y.e one part And Thomas Cheney of y.e County & Province afores.d of y.e other parte Wittnesseth that y.e said Jn.o Jacob as well for and In consideracon of y.e full and just sume of four Thousand Eight hundred pounds of Tob.o to him well and truly paid and Delivered by y.e s.d Thomas Cheney y.e recp.t whereof y.e s.d Jn.o Jacob doth hereby Accknowledge and therewith to be fully contented and paid & thereof and every parte & parcell thereof the s.d Thomas Cheney Doth Acquitt Exonorate and Discharge for Ever by these p.rsents Hath given granted bargained Aliened Enfeoffed sold and Confirmed and by these P.rsents for himselfe and his heires doth fully Freely and Absolutly give grant bargain and sell Alien Enfeoffen and Confirm unto y.e said The Said Thomas Cheney his heires Ex.rs Adm.rs or Assignes for Ever a parcell of Land taken out of a greater Tract or parcell of Land Knowne and Called by y.e name of Cheney Resolution lyeing and being on y.e south side of south River in y.e woods Beginning at a bounded Chesnut Tree and running South South East sixty six pearches to a bounded Ash Then South west to a bounded white oake Twenty four pearches then north East one hundred thirty and five pearches to a pare nee then north east and by now twenty pches to a bounded Poplar then w.th a streight Line to y.e first bounded Chesnut tree Containing and now laid out for Fifty Acres bee y.e same more or Less Together with all Trees woods & underwoods now standing growing or being in or upon y.e same & alsoe all and singular y.e rents proffitts Egress regress wayes passages watercourses priviledges and appurtenances whatsoever to y.e same belonging or in any wayes appertaining Together with all y.e Estate Right Title Intrest use property possesion Inheritance Claime & Demand whatsoever of him y.e said Jn.o Jacob and his heires of in ^or^ unto y.e same or any parte or parcell thereof & alsoe y.e Reversion & reversions remainder and remainders thereof To have and To hold y.e said Fifty Acres of Land and all and singular y.e premisses and Every parte or parcell thereof with y.e appurtenances unto him y.e said Thomas Cheney and his heires for Ever To and for y.e only proper use and behoofe of y.e said Thomas Cheney affores.d for Ever and that y.e said Jn.o Jacob for himself his heires Ex.rs Adm.rs for every of them Doth Covenant promise grant and agree to and w.th y.e said Thomas Cheney afores.d and his heires in manner and forme following that is to say That he the said Jn.o Jacob his heires Ex.rs and Adm.rs or some of them y.e s.d fifty Acres of Land and singular y.e p.rmisses before menconed and Intended to be hereby bargained & Every parte and parcell thereof w.th y.e Appurtenances unto him y.e said Thomas Cheney and his heires afores.d against himself and his heires and ag.t all and Every other person and persons whatsoever shall and will Warrant and for Ever Defend by these p.rsents and further that he y.e said Jn.o Jacob Now at y.e time of The |
