786) 805 Being thereunto had it doth and may more at large appeare Now these p.rsents wittnesseth that y.e said Edward Carter by virtue of the power afores.d are for and in the name of the said Thomas Francis party to these p.rsents and for & in Consideracon of y.e full and just sume of seaventy pounds ster to him y.e said Thomas Francis before y.e ensealing & delivery of these p.rsents in hand paid or secured to be paid by him y.e said Sam.ll Young y.e reciept whereof and of every parte and parcell thereof y.e said Edward Carter doth hereby for and in behalfe of the s.d Thomas Francis acknowledge and Confess and thereof and of every parte and parcell thereof doth hereby exonerate acquitt and discharge him the s.d Sam.ll Young his heires Ex.rs and Admin.rs hath given granted bargained sold aliened enfeoffed and confirmed as by these p.rsents he doth give grant bargain sell alien enfeoff and confirme unto him the s.d Sam.ll Young All that Tract or parcell of Land before mentioned lying and being in Beiny in Baltemore County as afores.d by a swamp called the Cranbery Swamp and beginning at a Bounded oake being a bounded tree of a parcell of Land formerly laid out for George Yate Gent called Betty's Choice and runing North Eeast two hundred perches to a Bounded oake then North west three hundred & twenty perches then south west two hundred perches to y.e line of the said Betty's Choice Then w.th w.th a streight line to y.e first bounded tree Containing and laid out for four hundred Acres of Land more or lesse To have and To hold the said Tract of Land and p.rmisses w.th all and singular its Rights members and Appurtenances whatsoever thereunto belonging unto him the said Sam.ll young his heires and assignes for ever free from and clear of all maner of incumberances whatsoever (the rent onely hereafter to grow due to y.e Right hono.ble The Lord Proprey.ry of this Province only excepted) And the said Thomas Francis by y.e said Edward Carter his s.d Atturney doth for himself his heires Ex.rs and admin.rs Covenant promise grant and agree to and w.th y.e said Sam.ll Young his heires and Assignes that the afores.d Tract or parcell of Land and p.rmisses w.th all and singular the Appurtenances thereunto belonging is at y.e time of y.e ensealing and delivery of these of the s.d p.rsents absolutly free and cleare as well from all or any former grant Bargain sale morgage or incumberance whatsoever had made comitted or done either by y.e said Thomas Francis or any other pson whatsoever as alsoe from runing into y.e lines of any former or more antient survey and that he the s.d Thomas Francis is at and before y.e ensealing of these p.rsents seised thereof by a good firme and indefeasable estate in fee simple and hath full and ample right to sell and dispose of the same to him y.e s.d Sam.ll Young and his heires for ever And further that he y.e s.d Thomas Francis the said Tract of Land and p.rmisses w.th all and singular y.e Appurtenances thereunto belonging unto him y.e said Sam.ll Young his heires and Assignes for ever against all psons whatsoever shall & will for ever warr.t and defend In wittness whereof y.e said Edward Carter by virtue of y.e power and authority soe as afores.d granted him hath hereunto sett as well y.e hand and seale of y.e said Thomas Francis as his own hand and seale y.e day and year first above written Recorded June y.e 1.st 1697 Maryland fs Know all men by these p.rsents that I Thomas Francis of Anne Arrundell County gent have made deputed Constituted and Appointed as by these p.rsents I doe make constitute and appoint my trust and well beloved friend Edw.rd Carter of Annearundell County gent my true and Lawfull Atturny for me and in my name to execute seale and Deliver a Certaine Deede of Bargaine and Sale of four hundred acres of Land lying in Baltemore County and Called Hollands Lott heretofore granted to Tho Francis my father and by right of Inheritante to me Descended unto Sam.ll Young of Annarundell County gent therein and thereby making unto him y.e said Sam.ll a firme and indefeasable Estate in fee simple w.th all such Covenants Grants and Clauses as shall be therein devised by y.e Councell Learned in y.e Law of y.e the said Sam.ll for y.e better assureance of y.e said Land unto him y.e said Sam.ll his heires and Assignes for ever hereby Granting unto my said Atturney full and ample power and authority to act doe and pforme all manner of acts necessary to be pformed towards vesting a sure and firme Estate in fee simple of and in y.e p.rmisses in y.e s.d Sam.ll whether by acknowledgm.t in my name according to y.e act of Assembly of the Province or otherwise hereby ratifieing and confirming what my said Atturney shall doe in y.e p.rmisses and houlding y.e same as firme and effectuall in y.e law to all intents and purposes as if actually done and executed by my selfe In wittness whereof I have hereunto sett my hand and seale this 29.th day of
