79 Parts and parcell thereof doe hereby cleerly and Absolutely Exonerate acquitt & discharge him the said Garrard Vansweringen the Receipt his heirs Execut.rs Adm.rs & assignes for ever by these presents hath given granted bargained aliened sold enfeoffed & Confirmed And doth by these presents give grant Bargain Alien sell Enfeoff & Confirme unto the said Garrard Vansweringen his heirs and assignes for ever All that parcell of Land Called and Comonly knowne by the name of Joseph Eldowes plantation formerly in the Occupation of Roger Sherling lyeing scituate and being and S.t Jeroms Creeke in S.t Michaells Hundred in the County aforesaid Begining at a point by the Creeke side runing North till you come to a Cove and soe up the Cove to a bound Chesnutt tree thence south till you come to a bound tree at the Edge of the swampe thence runing West to a bound Pine standing by the head of a Cove and layd out for fifty acres more or lesse And alsoe a parcell of land Called Joseph Hackneys being joyning unto the said fifty acres Beginning att a Corner tree att the Edge of the swampe and soe Runing south to the head of the Creeke ending & lyeing bewixt Henry Riders and the swamp att the head of the Creeke and laid out for Twenty five acres more or lesse and alsoe the Timber Trees that are in the swamp betwixt Henry Riders Path and the dwelling house of the said Plantation Together w.th all Howses Edifices Orchards Gardens and all and singular the other appurtenances to the same Belonging or any wise appertaining To have and to hold the said parcell of Land and the Bargained Premisses to the said Garrard Vansweringen his heirs and assignes for ever to the onely proper use & behoofe of the said Garrard Vansweringen his heirs & assignes for ever And the said Thomas Innes heirs Executors & Adm.rs the said severall and respective parcells of Land to him the said Garrard Vansweringen his heirs and assignes against all and every manner of persons whatsoever shall and will for ever hereafter warrant and defend by these presents the Rents & services hereafter (to become due) mentioned for the same viz.t Three Bushells and three pecks of Indian Corne to be paid to W.m Guyther or his assignes att the Mannor house of the said William Guyther forty dayes before or after the Nativity of our blessed saviour And the services to the aforesaid Mannor which by the Law the said Garrard Vansweringen his heirs or assignes ought to performe to the said W.m Guyther his heirs & assignes alwayes Excepted and foreprized and further that the said Thomas Innes his heirs and assignes shall and will from time to time and att all times hereafter dureing the space of seven yeares att the Request and att the propper Costs & Charges in the Lawe of him the said Garrard Vansweringen his heirs and assignes Make Doe acknowledge Execute & Suffer or cause to be made Done ^Acknowledged^ Executed & suffered all & every such further and other act or acts thing or things devise or devises assureance or assureances whatsoever requisite in the Premisses for the better & firmer Conveying & more suremakeing of the said Bargained premisses unto him the said Garrard Vansweringen his heirs or Assignes or his Councell Learned in the Law shall be reasonably devised advised or required In Wittnesse whereof the pties above named have hereunto Interchangeably sett their hands and seales the day and yeare above written Tho Innes sealed Signes sealed & Delivered inthe Presence of Sarah Einnss sealed Emo Dermott, John Walls Sarah Innes Signed sealed & delivered the above Deed as are act & deed to y.e uses therin mentioned In p.rsence of us Thoma Notley John Lewellin |
