78 only proper use and behoofe of the said Thomas Innes his heirs and assignes for ever And the said William Guyther his heirs Executors and assignes the said severall and respective parcells of Land and the bargained premisses to him the said Thomas Innes his heirs and assignes against all and every manner of persons whatsoever shall and will for ever hereafter warrant and defend by these presents the Rents and service hereafter (to become due) mentioned for the same viz.t three bushells & three pecks of Indian corne to be paid to the said William Guyther or his assignes att the manner house of the said William Guyther forty dayes before or after the Nativity of our blessed saviour and the services to the aforesaid Manner which by the law the said Thomas Innes his heirs or assignes ought to performe to the said William Guyther his heirs and assignes alwayes Excepted and foreprized And further that he the said William Guyther his heirs and assignes shall and will from tyme to tyme and att all times hereafter dureing the space of seven yeares att the Request and att the propper costs & Charges in the Lawe of him the said Thomas Innes his heirs & assignes make doe acknowledge Execute & suffer or cause to be made done Executed and sufferred all & every such farther and other act or acts thing or things devise or devises assureance or assureances whatsoever requisite in the premisses unto him the said Thomas Innes his heirs and assignes for ever be it by inrowlment of these presents fine feoffment or otherwise or by any other such lawfull wayes or meanes as by him the said Thomas Innes his heirs or assignes or his Councell learned in the Law shall be reasonably devised advised or required In Witnesse whereof the parties above said have interchangeably sett their hands & seales the day and yeare above specified William Guyther sealed signed sealed and delivered in the presence of us Alex Windsor Nicholas Guyther on the backside of the aforegoing deed was thus written viz.t Memorandum that peaceable possession and seizin of and in the mestuages and other the premisses within written with the appurtenances was delivered by the within named William Guyther to the within named Thomas Innes to the use and behoofe within limitted according to the tenor and Effect of this present writeing dated the 17.th day of March Annoq Domi 1675 In the presence of the Wittnesses hereafter named William Guyther Alex Windsor Nicholas Guyther Memorandum that this 30.th day of November Annoq Domini 1676 came W.m Guyther and did acknowledge the within mentioned Deed over unto Thomas Innes within named before us Philip Calvert W.m Calvert This Indenture made the Nineteenth day of May in the second yeare of the Dominion of Charles Absolute Lord & Prop.ry of the provinces of Maryland & Avalon Lord Baron of Baltemore &.ca Annoq Domini One Thousand six hundred seventy seven Between Thomas Innes & Sarah Innes his wife of the County S.t Maries in the said Provinces on the one part And Garrard Vansweringen of the same County and Provinces on the other part wittnesseth that the said Thomas Innes for and in Consideration of the full & Just sume or quantity of six thousand pounds of good sound M.rchantable Tobacco in Caske to him in hand paid by the said Garrard Vansweringen the Receipt whereof Doe hereby acknowledge And thereof & every part |
