(70) This Indenture made the tenth day of August in the foure & fortieth year of the Dominion of the R.t Hono.ble Cæcilius Lord and proprietary of the provinces of Mary Land and Avalon Lord Barron of Baltemore &c over Maryland &c Annoq Domini one thousand six hundred seaventy five Between Edward Southrin of Wiccomico River in the County of Somersett in the said province of Maryland planter and Mary his wife of the one part and Robert Ridgely of the Citty of S.t Maryes in the province of Maryland aforesaid Gent of the other part Witnesseth that whereas the said Land and prop.ry by his Lett.rs pattents under the grate seale of the said province was for granting lands theire bearing date at S.t Maryes the seaventh day of August in the six and thirtieth yeare of his said Lords.pps Dominion over his s.d province of Maryland and in the yeare of our Lord one thousand six hundred sixty & seaven then the Consideracon therein named did grant unto Stephen Horsi of Som.rsett County in the province of Mary Land gent a pcell of land Called Horsys Baliwick Lyeing in Som.rsett County on the South side of Tomacktico River begining at the Mouth of a small Gutt called Cowasike dividing it from the land of Robert Ingram thence runing North east by the River side to a marked pyne standing by the River side above lines Tomacticoe Thence runing South East to the Land of Richard Bennett thence runing Southwest to the Land of Robert Ingram w.th a line drawne North West to the first bounder Containing and then laid out for five hundred acres more or lesse To Have and to hold the same unto him the said Stephen Horsy his heires and assignes for ever under his Rents and Services as in the said Lett.rs pattents are rented and expressed and whereas the said Stephen Horsey being by vertue of the said Lett.rs pattents possessed of the said lands in therein his owne Right afterwards (to witt) the nine and twentieth day of September in the yeare of our Lord one thousand six hundred sixty and eight by his Certaine deed poll duely executed and enrolled did Convey his whole Right Title and Interest of in and to the premisses and ev.ry part and parcell thereof unto the said Edward Southrin his heires & assignes for ever w.ch said Edward Southrin and Mary his wife being soe thereof possessed by theire Certaine Indenture duely specified due acknowledged and bearing date the ninth day of June in the five and fortieth yeare of the Dominion of his s.d Lordshipp over Maryland &c Annoq Dom one thousand six hundred seaventy and foure did Convey and make over unto Phillipp Nyson of the same County plant.r Two hundred acres part of the said five hundred acres of Land begining at the first bounder menconed in the pattent and soe runing by the River North East sixty perches for breadth and thence runing afterwards for length and breadth againe to the first bounder according to the Common usage & Customes of surveyes to the said Land quantity of Land and Containing two hundred ac.rs and being Called Phillippus and whereas the said Edward Southrin and Mary his wife being still possessed in theire owne Right of three hundred acres Residue of the said five hundred acres of Land Now this Indenture further Witnesseth that the above named Edward Southrin and Mary his wife for and in Consideracon of the full and Just summe of seaven thousand five hundred pounds of good sound Merchantable Tobacco and Caske to them in Hand payd by the above named Robert Ridgely the receipt whereas and of every part and pcell thereof they the said Edward and Mary doe hereby acknowledge and hereof and of every part and parcell thereof do hereby exonerate acquitt and discharge the said Rob.t Ridgely his heires and assignes for ever by these p.rsents have given granted bargained aliened sould enfeoffed and Confirmed and by these p.rsents for us our heires Exec.rs and Adm.rs doe Give grant bargaine alien sell Enfeoff and confirme unto the said Robert Ridgely his heires Executors Adm.rs and assignes all that tract pcell of divideing of Land Called little Bellean and residue of the said parcell of land containing five hundred acres called Horsys Baliwick and whereon wee the said Edward and Mary Now live containing by Estimacon Three hundred acres bee it More or Lesse and adjoyning unto the said Two hundred acres of Land by us sould unto the said Phillipp Nysell Together with all rights proffitts and benefitts thereunto belonging or in any wise apperteyning Together with all deeds Evidences pattents grants Charters Escripts writeings and Miniments whatsoever of or Concerning the same with all and singular the houses buildings Eddifices wayes Easements Gardens orchards Creeks Fishings Fisshing places to the same three hundred acres of Land Called little Bellean in any manner apperteyning To Have & to Hold the said land and p.rmisses and every part and parcell thereof at the only propper use and behoof of him the said Rob.t Ridgely his |
