51 And the said John Darnall on the other part bearing even date with these p.rsents according to the true intent & meaning of the said Indenture Then this Obligacon to be void or else to stand & be in full power force & vertue Signed Sealed & delivered in the p.rsence of us Richard Fenwick sealed John Craycroft Henry Darnall John Evans Underneath the aforegoing bond was thus written viz.t Octob.r 3.d 1677 The above written bond was acknowledged in open Court to be the act & deed of him the above bounded Richard Fenwick Jn.o Blomfeild Cl Cur Provinc This Indenture Made the Nynteenth Day of October in the three & fortieth yeare of the Dominion of Cacilius Absolute Lord & Prop.ry of the Provinces of Maryland & Avalon Lord Baron of Baltemore &c between Nicholas Guither of S.t Michaells hundred in S.t Marys County Planter of the one part & Richard Attwood of the aforesaid hundred in the said County alsoe Planter of the other part wittnesseth that the said Nicholas Guither in Consideracon of the sum of Eleven thousand pounds of good and Merchantable Tobacco in Casque Whereof the said Nicholas Guither is full satisfied Contented & Paid of the sume of three Thousand pounds of Tobacco the other eight thousand to be paid by the said Richard Attwood in two severall payments That is to say the Nynteenth day of October which shall be in the yeare of our Lord God One thousand six hundred seaventy & six for the which Payment well and truely to be made the said Richard Attwood hath upon the day & yeare of the date hereof given his severall bills for the Payment of the said severall sums of Tobacco to the said Nicholas Guither That the said Nicholas Guither hath Bargained & sold And by these presents doth Bargain & Sell unto the said Richard Attwood & his heirs all that freehold or parcell of Land called Eastmore Lying and being on S.t Jeromes Creeke in S.t Maryes County begining att a bounded Chesnutt & runing West to An Oake thence North to a white Oake Thence East South East to a bounded Gum tree & soe bounded by the Creeke to the said Chesnutt Tree Contayning four hundred Acres more or lesse w.th all the appartenances Rights & Titles thereunto belonging all which Premises were some tymes and did properly belong to John Guither of Sossofrix River in Baltemore County the Brother of the said Nicholas Guither and are now in the tenure and occupation of the said Nicholas Guither or his assignes by vertue of a letter of Attorney dated twentieth day of October Annoq Domi sixteene hundred seaventy three & Proved by the Oath of John Smalpeece of S.t Maryes County before the Honn.ble Philip Calvert Esq.r Chancell.r & Judge in Testamentary causes for the aforesaid Province of Maryland to him granted by the said John Guither thereof and its appartenances to dispose and the said Nicholas Guyther for him his heirs and assignes and every of them doth Covenant & grant to and with the said Richard Attwood and his heirs that he the said Richard Attwood att the Ensealing and delivery of these presents is Lawfully seized of all and singular the premisses with their appartenances as descended & Come by Custome of this Countrey Province of Maryland unto the said Nicholas Guither from John Guither the Brother of the said Nicholas Guyther A Goe the said Nicholas Guither doth Covenant and grant to & with the said Richard Attwood and his heirs to discharge or otherwise save harmless the said Richard Attwood of and from all former bargains sales surrenders forfeitures or Incumbrances whatsoever had made Comitted or done by the said Nicholas Guither or John Guither the Brother of the said Nicholas Guither or by any other person or persons whatsoever haveing holding or claiming from by or under them or any of them And that the said Nicholas Guither & his heirs shall and will att the Costs & Charges of the said Richard Attwood his heirs Execut.rs & Adm.rs from time to time Acknowledge performe doe and Execute & suffer to be done Performed acknowledged & Executed such reasonable Act or Acts Thing or things which by the said Richard Attwood his heirs or assignes or his or theire Councell learned in the law of the Aforesaid Province shall be reasonably devised advised & required for the lawfull & better assurance & Conveyance of all and singular the Premisses aforesaid to the said Richard Attwood & his heirs according to the Custome of the aforesaid Province & according to the true intent & meaning of these Presents Provided allways that the said Nicholas Guither shall not by reason of any Covenant or article herein Expressed for the passing of any assureance or assureances of the premises or any part or parcell thereof be Inforesed or Compelled to transmitt out of the aforesaid Countey of S.t Maryes Further the said Nicholas Guither doth Covenant and grant to and w.th the said Richard Attwood to deliver or Cause to be delivered to the Richard Attwood his heires |
