50 Their own proper use & behoofe as aforesaid from & against him the said Richard Fenwick his heyres & assignes & against the said Cuthbert Fenwick his heyres & assignes & every of them & from & against all & every other person or persons lawfully claiming or to clayme by from or under the said Richard Fenwick or from by or under the said Cuthbert Fenwick or his or either of their heyres or either of their act or acts or Estate shall & will warrant & for ever defend by these p.rsents And further the said Richard Fenwick doth for himselfe his heyres Ex.rs & Adm.rs covenant promise & grant to & with the said John Darnall his assignes That he the said John Darnall his heyres & assignes shall & may from hence forth & att all tymes hereafter lawfully peaceably & quietly have hold use possesse occupy & enjoy all & singular the aforemenconed land & p.rmisses & every of them without any manner of suite trouble or interrupcon recovery denial or hindernace whatsoever of or by him the said Richard Fenwick his heyres or assignes or of or by the heyres or assignes of the said Cuthbert Fenwick or any of them his or their or any of their act or Estate And that free & cleerly acquitted discharged & saved harmles & kept indempnified of & from all & singuler former & other bargaines sales guifts grants Leases Joyntures Dowers Wills & Fines uses Intayles Mortgages Annuityes Rents Arrearages of rent & of & from all other charges & incumbrances whatsoever had made done comitted or suffered or assented unto by him the said Richard Fenwick or by the said Cuthbert Fenwick or their or either of their heyres the rents & services which from henceforth shall grow due & payable to the chiefe Lord or Lords of the Fee or Fees of whom the said land & p.rmisses are holden only excepted & foreprized And further the said Richard Fenwick doth for himselfe his heyres Ex.rs & Adm.rs covenant promise & grant to & with the said John Darnall his heyres & assignes that he the said Richard Fenwick his heyres & assignes shall & will from henceforth & att all tymes hereafter upon every reasonable request & att the proper costs & charges in the Law of him the said John Darnall make do acknowledge suffer or cause to be made done acknowledged & suffered all & every such further & other reasonable act & acts thing & things device & devices assurance & assurances whatsoever requisite in the p.rmisses for the further better & more perfect assurance surety & suremakeing of all & singular the aforemenconed to be hereby bargained p.rmisses with their & every of their appurtennces as by the Councell learned in the Law of the said John Darnall shall be reasonably devised advised or required In wittnes whereof the partyes first above named to these p.rsents interchangeably have sett & putt their hands & seales the day & yeare first abovewritten Signed sealed & delivered in the p.rsence of us Richard Fenwick sealed John Craycroft Henry Darnall John Evans On the backside of the aforegoing Deed was thus written viz.t Octob.r the 3.d 1677 The within written Deed of Indenture was then in open Court acknowledged by the within named Richard Fenwick to be his act & deed to the uses in the same Indenture specified Jn.o Blomfeild Cl Cur Provinciall Know all men by these p.rsents That I Richard Fenwick of Calvert County in the Province of Maryland planter and holden & firmly bound unto John Darnall of the Said County & Province gentl in the full & just sume of five hundred pounds sterling of lawfull money of England to be paid to the said John Darnall his heyres Ex.rs & Adm.rs To which paym.t truely to be made I binde me my heyres Ex.rs & Adm.rs firmly by these p.rsents In wittnes I have hereunto sett my hand & seale this tenth day of July 1677 The Condicon of this Obligacon is such That if the above bound Richard Fenwick his heyres Ex.rs & Adm.rs shall & will & doe from tyme to tyme & att all tymes hereafter well & truely observe pforme fullfill & keep all & every the Articles guifts grants sales Covenants & Agreem.t which on the part & behalfe of the said Richard Fenwick his heyres Ex.rs & Adm.rs or either of them are to be well & truely observed performed fullfilled & kept as are written menconed contained & specified in a certaine Indenture of bargaine & sale made between the said Richard Fenwick on the one part (& |
